About this skill

/subpoena-triage
  1. Read the provided investigation order/assistance-investigation notice document.
  2. Classify (court investigation order / lawyer investigation order / administrative agency assistance-investigation notice / witness appearance notice / supervisory commission/criminal investigation).
  3. If it is a supervisory commission/criminal investigation → stop, report per ~/.claude/plugins/config/claude-for-legal-zh/litigation-legal/CLAUDE.md . Otherwise continue.
  4. Load ~/.claude/plugins/config/claude-for-legal-zh/litigation-legal/matters/_log.yaml for cross-searching. Load ~/.claude/plugins/config/claude-for-legal-zh/litigation-legal/CLAUDE.md → practice background, confidentiality practices, reporting rules.
  5. Operate according to the following workflow.
  6. Extract key fields, analyze scope/burden/confidentiality, and generate an objection framework + compliance plan + deadline calendar.
  7. Write to ~/.claude/plugins/config/claude-for-legal-zh/litigation-legal/inbound/[slug]/triage.md. Copy or link the investigation order to ~/.claude/plugins/config/claude-for-legal-zh/litigation-legal/inbound/[slug]/incoming.[ext]。
  8. Referral: if the preservation notice is not in place → /legal-hold --issue; if importance is sufficient → /matter-intake; if it is a party investigation order in an existing case → /matter-briefing [slug]。

Investigation order/assistance-investigation notice triage

Purpose

Investigation orders and assistance-investigation notices come with deadlines. Common failure modes: missing the deadline, over-producing (waiver of confidentiality privilege, burden that should have been objected to), under-producing (risk of non-cooperation), or missing the window to apply for revocation. This skill classifies, analyzes, and generates a compliance plan and objection framework.

Jurisdiction assumptions

The legal application of investigation orders and assistance-investigation notices varies by type and jurisdiction:

  • Court investigation order: based on Article 67 of the Civil Procedure Law and Articles 94-96 of the Interpretation of the Civil Procedure Law.[法条原文]
  • Lawyer investigation order: implementation measures for lawyer investigation orders formulated by the high court of each province/municipality directly under the Central Government; the rules vary by province/municipality.
  • Administrative agency assistance-investigation notice: based on various specialized administrative regulations (such as market regulation, taxation, securities regulation, etc.).
  • Supervisory commission/criminal investigation: based on the Supervision Law and the Criminal Procedure Law — a criminal lawyer should be consulted immediately.

Every rule citation in this skill is a starting-point heuristic — confirm current validity and local variations before raising objections in writing or cooperating.

Load context

  • Investigation order/assistance-investigation notice document (path provided by the user or sent in the session)
  • ~/.claude/plugins/config/claude-for-legal-zh/litigation-legal/matters/_log.yaml — for related-case searching and evidence preservation status
  • ~/.claude/plugins/config/claude-for-legal-zh/litigation-legal/CLAUDE.md → practice background (regulators commonly dealt with), firm confidentiality practices, reporting rules

Workflow

Step 0: Research the applicable rules

Before analyzing this investigation order/assistance-investigation notice, research the applicable procedural rules. For court investigation orders, check Article 67 of the Civil Procedure Law and Articles 94-96 of the judicial interpretation; for lawyer investigation orders, check the implementation measures of the high court of the province/municipality where you are located; for administrative agency assistance-investigation notices, check the relevant administrative regulations. Determine: territorial jurisdiction limits, objection deadlines (counted from receipt), confidentiality review requirements, and cost bearing. Cite precise locations. Verify timeliness — rules and local variations may change.

Do not supplement silently. If a query to the configured legal research tool returns zero or very few results, report what was found and stop. Do not fill the gap from web search or model knowledge without asking. Say: "The search returned [N] results from [tool]. Coverage of [rule/jurisdiction/variant] appears thin. Options: (1) broaden the search query, (2) try another research tool, (3) search the web—results will be marked[联网检索——需复核], verify before relying on them, (4) stop here. Which would you like?" It is the lawyer's decision whether to accept lower-credibility sources.

Source labeling. Label the source for each rule citation, case, statute, and regulation in the triage output:[yuandian检索]for citations obtained through the retrieval connector;[联网检索——需复核]for web search citations;[模型知识——需验证]for citations recalled from model knowledge;[用户提供]for citations provided by the user (such as in a court order or prior case work). Label citations marked需验证as having high fabrication risk and verify them first. Do not remove or compress the labels.

Step 1: Classify

Court investigation orders and assistance-in-investigation notices are different types with different rules; confirm the specifics against the rules just researched:

  • Court investigation order (civil litigation) — Our side is not a party to the litigation; the court or opposing counsel applies to obtain our documents. Common objection categories: relevance, burden, confidentiality, geographic jurisdiction.
  • Attorney investigation order — Opposing counsel obtains evidence using an investigation order issued by the court. Review: whether the issuance of the investigation order is lawful, whether the scope of investigation exceeds what is necessary, and the protection of trade secrets or personal privacy involved.
  • Administrative agency assistance-in-investigation notice — Market Supervision Administration, Tax Bureau, CSRC, CBIRC, etc. Different agencies have different rules; the posture is usually more cooperative but the consequences are also greater.
  • Witness appearance notice — The court notifies our employee to appear as a witness. Involves witness preparation, scope, relevance.
  • Supervision Commission/criminal investigation notice — Criminal proceedings. Report immediately to criminal counsel; outside the scope of this skill—label for escalation.

Step 2: Extract key fields

  • Issuing authority — Which court (specific name), which administrative agency
  • Applicant — Who applied (if civil litigation)
  • Case number/case name — Which case is involved
  • Categories of documents sought — numbered list
  • Appearance/examination topics(if a witness is involved)
  • Deadline for response/objection — date of service + response window calculated under the applicable rules
  • Production date — by when the documents must be produced
  • Geographic scope — the document custodians, locations, systems involved
  • Contact/reply recipient — who within the company is the document custodian/recipient

Step 3: Cross-check against the case portfolio

  • Party investigation order → whether it relates to an existing case: verify whether the case number matches a case in _log.yaml . If it matches, route to that case's workflow; this triage is informational in nature.
  • Third-party investigation order → case number not recognized by us: record the party information; file as a standalone incoming item.
  • Multiple subpoenas in the same case: Mark coordinated issuance; a unified response strategy may apply.

Step 4: Analyze scope, burden, confidentiality

Scope/Relevance

  • Do the categories of documents sought correspond to documents we might actually possess?
  • Are any categories overbroad or a "fishing expedition" unrelated to the disputed issues in the case?
  • Territorial jurisdiction—apply the researched rules; different types (court subpoena vs. attorney subpoena) have different limits.

Burden

  • Custodians involved, systems to be searched, time span
  • Estimated volume (rough: small/medium/large/very large)
  • Cost—third-party respondents may have cost-sharing mechanisms.

Confidentiality

  • Might it involve attorney-client privileged content? (Almost anything involving legal is; communications involving in-house legal or outside counsel especially require attention.)
  • Does it involve trade secrets? (Article 9 of the Anti-Unfair Competition Law)[法条原文]
  • Does it involve personal information? (Personal Information Protection Law—the legal basis must be assessed before providing)[法条原文]

Other grounds for objection

  • Confidentiality—is a protective order needed?
  • Duplication—has the other side already obtained it from another party?
  • Non-possession—we do not have what the other side requested (specify)
  • Improper service—does it comply with the service requirements of the applicable rules

Step 5: Objection framework

Draft a structured objection outline—not the final objection, but an outline of which objections apply and their reasons. The user (usually together with outside counsel) finalizes it.

For each objection:

  • Legal basis—cite the precise location in the rules researched in Step 0
  • Specifically applicable to this subpoena (which categories, which custodians)
  • Strength (strong / reasonable / weak)

Step 6: Compliance plan

Even if objections are raised, some of the requested content is usually still provided. Plan:

  • Expected scope of production — what will still be provided after objections
  • Custodians to be searched — names and systems
  • Date range
  • Review plan — who is responsible for confidentiality review (us, outside counsel, contract review personnel)
  • Production format — as required by the subpoena or as negotiated
  • Confidentiality log requirements — format, fields

Step 7: Deadlines

Use the deadlines identified in the Step 0 research. Note that objection deadlines are calculated differently under different procedures—do not default to a single number.

  • Response deadline — per the rules identified in the research
  • Objection deadline — per the rules identified in the research (may be within a certain number of days after receipt)
  • Production date — if the objections are unsuccessful
  • Window for moving to quash — if this path is taken, timing is critical

Put everything on the calendar. Immediate action items.

Step 8: Write the triage opinion

Step 9: Handoff

Before responding to an investigation order/investigation assistance notice (objection, document production, court testimony, or motion to quash — any substantive response to the issuing authority or court): Read the ~/.claude/plugins/config/claude-for-legal-zh/litigation-legal/CLAUDE.md in ## 使用者. If the role isnon-lawyer:

Responding to an investigation order/investigation assistance notice has legal consequences — missing a deadline risks refusal to cooperate, over-producing waives confidentiality protection, and under-producing risks penalties. Have you reviewed this matter with a lawyer? If reviewed, continue. If not reviewed, here is a brief to take to a lawyer:

[Generate a one-page summary: type of investigation order/notice, issuing authority, deadline, scope of documents required, objection framework and strength, confidentiality and burden issues, proposed response posture, what could go wrong, questions to ask the lawyer.]

If you need to find a lawyer: contact your local bar association or call the 12348 legal aid hotline for a referral.

Do not cross this threshold until explicit confirmation is received. Triage, scope assessment, and internal scheduling do not require this threshold — a response to the issuing authority does.

  • If classified asSupervision Commission/criminal investigation → stop, escalate with the ~/.claude/plugins/config/claude-for-legal-zh/litigation-legal/CLAUDE.md label, and do not perform standard triage.
  • If classified asadministrative agency investigation assistance notice: note the applicable specific regulator's practices; recommend engaging outside counsel familiar with that regulatory field.
  • Otherwise: offer to create a case (generally recommended — investigation orders are often important enough to track).

Close with the next-step decision tree

Close with the next-step decision tree in CLAUDE.md ## 输出 . Customize the options based on what this skill just produced — the five default branches (draft X, escalate, get more facts, wait and see, other options) are a starting point, not a locked-in set. The decision tree itself is the output; the lawyer chooses.

What this skill does not do

  • Draft the final objection. Generates a framework; the objection is drafted by the user + outside counsel.
  • Move to quash the investigation order. Presents options; a motion to quash is litigation legal work requiring jurisdiction-specific analysis.
  • Independently verify rules across jurisdictions. Step 0 research generates the applicable rules; this skill does not independently confirm limitations periods or local variations. Flag for lawyer verification before acting.
  • Handle criminal procedure investigations. Escalate. Outside the scope of this triage.
