About this skill

/portfolio

Show upcoming renewals, add assets, record payments, audit the register.

Instructions

  1. Follow this workflow and read ~/.claude/plugins/config/claude-for-legal-zh/ip-legal/portfolio.yaml。

  2. Default (no argument): equivalent to --report — show items due within the next 90 days, grouped by urgency (🔴 lapsed/grace period, ⏰ due within window, 🟡 due soon, 🌐 agent-managed, ❓ unknown).

  3. --report [--days N]: Mode 2. Use --days(30/60/90/180) to change the window. Always prepend the work product header before output and close with the verification reminder as specified in CLAUDE.md → Output.

  4. --add: Mode 3. Interactively add a new asset — type, jurisdiction, number, dates, rights holder, business owner. If the jurisdiction is not in the built-in rules, record a custom rule.

  5. --update: Mode 4. Record that maintenance fee payment or annuity payment has been completed, synced with the IP management system, or change the asset status. Before setting any due date to 已缴纳 , execute the corresponding action threshold.

  1. --audit: Mode 5. Broader health check — due date hygiene, registration gaps, commercial use issues for trademarks about to meet the Article 49 trademark use requirement, rights holder inconsistencies, renewal outlook, unmonitored trademarks.

  2. If the register is empty and the IP management system is connected: Choose Mode 1 — pull the portfolio from the system records and initialize the register.

  3. Safety guardrail reminder: Calculated due dates are for reference only. Every output ends with a reminder line, requiring verification with the China National Intellectual Property Administration trademark query system, China patent publication and announcement system, WIPO, or the relevant registration authority before filing or paying. Recorded but wrong due dates create false confidence; unless the IP management system is synced and integrated, do not let users treat this as a system record.

Examples

/ip-legal:portfolio
/ip-legal:portfolio --report --days 180
/ip-legal:portfolio --add
/ip-legal:portfolio --update
/ip-legal:portfolio --audit

Purpose

Trademark registrations not renewed on time may be canceled. Patents with unpaid annuities lapse. Expired domains may be squatted within an hour. All of these are avoidable, and everything depends on one thing: the correct due date on someone's calendar, linked to the correct registration number, in the correct jurisdiction.

This skill maintains that calendar.

Important: Due date reference reminder

The due date rules applicable to this skill reflect public requirements as of the date this skill was built. IP office requirements, grace periods, fee structures, and maintenance fee standards change.Always confirm the calculated due date with the China National Intellectual Property Administration trademark query system/patent publication and announcement system, WIPO Madrid Monitor/patent search, EUIPO eSearch, or the relevant national registration authority before acting.

A recorded but wrong due date is worse than an unrecorded one: it creates false confidence. A "no upcoming due dates" output deserves a second confirmation.

Jurisdiction and type assumptions

Maintenance mechanisms vary by jurisdiction and asset type:

  • China trademarks: A registered trademark is valid for ten years, calculated from the date of approval of registration (Trademark Law Article 39 [法条原文]). Renewal of registration shall be handled within twelve months before expiration, with a six-month grace period (Trademark Law Article 40 [法条原文]). Renewal within the grace period requires payment of a late fee.
    • Trademark use obligation: If a registered trademark has not been used for three consecutive years, any entity or individual may apply to the China National Intellectual Property Administration for revocation (Article 49 of the Trademark Law [法条原文], commonly known as "revocation for non-use"). Unlike the U.S. §8 declaration of use system—China has no periodic declaration of use system, but rather a passive revocation-for-non-use system. Retaining evidence of use is crucial for defending against revocation for non-use.
  • Madrid international trademark: Ten-year registration term, renewable at WIPO; individual designated countries may have local use or declaration requirements (e.g., U.S. §71).
  • EUIPO trademark: Ten-year renewal; six-month grace period with surcharge.
  • Chinese invention patent: Patent rights last twenty years from the filing date (Article 42 of the Patent Law [法条原文]). Annual fees shall be paid starting from the year the patent right is granted (Article 43 of the Patent Law [法条原文])。
    • Annual fee: Paid annually. There is a six-month grace period after the deadline (including late payment penalty). After the grace period, restoration procedures may be carried out.
  • Chinese utility model patent: Ten-year term, calculated from the filing date. Annual fees are the same as for invention patents.
  • Chinese design patent: Fifteen-year term, calculated from the filing date. Annual fee payment is the same as above.
  • EPO / national patents: Annual fees are typically paid each year from the filing date or entry into the national phase. Rules vary by country—confirm by jurisdiction.
  • Chinese copyright: No renewal required. For works of natural persons, the term of protection is the author's lifetime plus fifty years; for works of legal entities, fifty years after first publication (Article 23 of the Copyright Law [法条原文])。
  • Domain names: Renewed annually or for multiple years (determined by the registrar); typically a 30-day grace period followed by a redemption period (about 30 days at a higher cost) and then cancellation.

If the portfolio contains assets in jurisdictions not listed above, capture the maintenance mechanism in the custom_rules block of the register, and the report will display it as agent_managed—confirm the status with the foreign agent rather than calculating dates this skill does not understand.

next_deadlines Status values:

  • due_soon — Expiring within 90 days, unpaid
  • overdue — Past the main expiration date, within the grace period (if any)
  • grace — Within the grace period (explicitly marked — with surcharge)
  • lapsed — Past the grace period with no action taken; asset effectively lost (unless restorable)
  • filed — Paid for this cycle

Mode 1: Initialization

Run when there is no register, or use --rebuild。

Step 1: Determine the source

Read ~/.claude/plugins/config/claude-for-legal-zh/ip-legal/CLAUDE.md:

  • IP management system connected: Pull the portfolio through the integration. The IP system is the authoritative source; this register mirrors it and does not add expiration dates the system already has.
  • No IP management system, but a spreadsheet/export is available: Ask the user to share the export. Import existing content; flag assets missing a registration date or grant date as expiration dates to be calculatedunknown。
  • No source at all: Interactively enter assets one by one — type, jurisdiction, number, key dates, rights holder.

Step 2: Calculate expiration dates asset by asset

Apply the rules at the top of this document. Populate next_deadlines For the next two to three upcoming deadlines—further deadlines (renewals decades away) are calculated on demand in reports rather than pre-stored.

Step 3: Write to the register

Generate at the configured path portfolio.yaml. Display a summary:

知识产权组合登记簿已初始化。

  商标: [N] ([N] 已注册 / [N] 申请中)
  专利: [N] ([N] 已授权 / [N] 申请中)

Mode 2: Report

/ip-legal:portfolio --report [--days 30|60|90|180]

Default window: 90 days. Before generating a report, refresh each asset's calculated deadline—do not rely on stored dates alone.

Output (append the work product header, by ~/.claude/plugins/config/claude-for-legal-zh/ip-legal/CLAUDE.md → output):

End the report with a prompt line:"Computed based on the IP portfolio register. Verify each deadline with the China National Intellectual Property Administration/WIPO/registration records office before filing or paying fees."

If the report lists more than about 10 assets, or when the user needs it: provide a data dashboard. Present it as: counts by registration status (active / grace period / lapsed / pending), a deadline timeline, and a sortable portfolio table (including jurisdiction, type, and next action date).

Mode 3: Add

/ip-legal:portfolio --add

Interactively add a single asset. Ask:

  1. Type (trademark / patent / copyright / design / domain)
  2. Jurisdiction
  3. Trademark or name / title of invention
  4. Right holder (registered proprietor — affects non-use cancellation defense and assignment)
  5. Key dates (by type: filing date, registration date, grant date, priority date, expiry date)
  6. Number
  7. Classes / number of claims
  8. Source — is it tracked by docket ID in the IP management system?
  9. Outside counsel / foreign agent (if any)
  10. Business owner (for whom is this asset important — product line, brand manager)

After collection:

  • Calculate the next deadline according to the rules at the top of this document.
  • If the jurisdiction's rules are not in the built-in list, use the custom_rules collection process (see below).
  • Append to portfolio.yaml in assets:。

Custom rule collection

When the jurisdiction is not in the built-in list:

I do not have built-in maintenance rules for [jurisdiction] / [asset type]. Let me collect these rules for future tracking.

  1. What maintenance event applies? (Renewal every N years? Annual fee? Declaration of use? Other?)
  2. What triggers the deadline—filing date, registration date, grant date, national phase entry, an anniversary date?
  3. Is there a grace period? What are the fees?
  4. Is there a foreign agent or local agent managing this?

Store to custom_rules: and apply it to future assets in that jurisdiction.

Mode 4: Update

/ip-legal:portfolio --update

Corresponding action thresholds

Before recording that a maintenance fee or annual fee payment is complete: Read ~/.claude/plugins/config/claude-for-legal-zh/ip-legal/CLAUDE.md in ## 使用者. If the role isnon-lawyer:

Recording a renewal registration, annual fee payment, or international annual fee as "paid" has consequences. If recorded incorrectly—wrong deadline, wrong fee reduction eligibility—the deadline does not change, and the asset may still lapse. Have you verified with the lawyer or foreign agent who actually handled the matter (or with the China National Intellectual Property Administration inquiry system/WIPO Madrid monitoring/the relevant registration authority)? If yes, continue. If no:

  • Do not record it as paid for now.
  • The following is the information you should bring to the lawyer: asset ID, jurisdiction, deadline type, what the IP management system shows, what you believe has been done and when, and the source of that belief.

If you need to find a practicing lawyer: your local bar association's referral service is the fastest starting point.

Without explicit consent obtained through this gate, the deadline status may not be set to filed. Status refreshes, report generation, and upcoming deadline displays do not require this gate.

Sub-modes

Manual update: "We paid the renewal fee for TM-CN-001 on March 4." Update the matching deadline:status: filed、filed_date, and calculate the next deadline in its lifecycle.

Sync from IP management system: If an IP management system is connected, pull the latest docket and reconcile. Flag mismatches between the register and the system of record — the system of record prevails; update the register to match and show anything the register has that the system does not.

Status change: "Mark TM-CN-004 as abandoned." Update status, clear next_deadlines, and record the abandonment date.

Mode 5: Audit

/ip-legal:portfolio --audit

Broader health check beyond this month's deadlines:

Deadline hygiene

  • Are there any deadlines currently in grace status? (In progress but incurring surcharges.)
  • Are there any lapsed assets not marked abandoned or cancelled? Restore or update the status.
  • Are there any assets with no calculated next_deadlines? Missing data or a jurisdiction this skill does not know.

Registration gaps

  • Trademark application filed more than two years ago and still pending? Flag that a status check at the trademark office is needed — substantive examination or a rejection review may be required.
  • Patent application filed more than four years ago and still pending? Flag that an examination status check is needed.

Commercial use / non-use cancellation risk (trademarks only)

  • Article 49 of the Trademark Law [法条原文] provides that anyone may apply for cancellation if a registered trademark has not been used for three consecutive years. Flag trademarks more than three years from the registration date whose use status is uncertain — evidence of use should be compiled before a non-use cancellation notice is received.

Ownership hygiene

  • Are there assets whose owner is not a currently valid entity? Flag — a recordal of assignment may be needed.
  • Is the rights holder name the same entity but expressed inconsistently? Show for cleanup.

Expiry outlook

  • Are any patents expiring in the next 24 months? Even with no maintenance deadline, the business may care — product planning, continuation application strategy, licensing windows.

Unwatched assets

  • Are there registered trademarks not in the CLAUDE.md → brand protection watch list? Flag the gap for the lawyer to decide whether to add.

What this skill does not do

  • It does not file anything. Every action it displays requires a lawyer or foreign agent to carry out.
  • It does not verify deadlines with the CNIPA inquiry system, WIPO, or any other registration authority. It calculates from the dates you provide. The register is a working copy; the registration authority is the source of truth.
  • It does not decide whether to renew. Renewal is a business decision—whether the trademark is still in use, whether the patent still has value, whether the domain name still matters. This skill shows due dates and costs; the business and the lawyer make the decision.
  • It does not replace an IP management system for portfolios of hundreds of assets. Professional IP management systems have direct registry queries, due-date automation, and annuity payment services. This skill is best suited for portfolios of below-medium scale, or as a lightweight layer that displays what is in the system of record.
  • It does not read official records to verify status. A renewal shown here as "paid" means someone said it was—not that the China National Intellectual Property Administration has accepted it. Confirm acceptance through the official query system or an IP management system.
