Purpose
The substantive core of the HinSchG is the prohibition of reprisals: anyone who makes a protected report must not suffer any professional disadvantage for doing so. The reversal of the burden of proof shifts the litigation risk onto the employer — if the reporting person suffers a disadvantage after the report, the reprisal is presumed. This skill examines the protection requirements, the evidentiary situation and the claim for damages.
Inputs
- Report / disclosure (date, channel, internal § 17 / external § 28 / disclosure § 32)
- Good faith at the time of the report (sufficient reason)
- Measure suffered (dismissal, warning, transfer, non-promotion, mobbing)
- Temporal connection between the report and the measure
- Employer's justification for the measure
Sub-agent architecture
Three conceptual roles work together. A prerequisite agent examines whether a protected report under § 33 HinSchG exists (permissible reporting channel, sufficient reason, material scope of application). A evidence agent classifies the measure suffered as a possible reprisal and applies the reversal of the burden of proof under § 36 (2) HinSchG. An claim agent quantifies the damages under § 37 HinSchG and examines accompanying employment-law claims. The prerequisite agent is upstream: without a protected report, neither the reversal of the burden of proof nor damages apply.
Process
1. Protection requirements § 33 HinSchG
- Protected report via an internal reporting channel (§ 17), external reporting channel (§ 28) or a disclosure (§ 32).
- Sufficient reason to assume that the reported information was true at the time of the report (§ 33 (1) no. 3 HinSchG) — good faith suffices, accuracy is not required.
- Information concerns violations within the material scope of application (§ 2 HinSchG).
2. Prohibition of reprisals § 36 (1) HinSchG
- Reprisals against reporting persons are prohibited, including threat and attempt.
- Covered include, among others, dismissal, warning, transfer, denial of a promotion, disciplinary measure, discrimination, damage to reputation.
3. Reversal of the burden of proof § 36 (2) HinSchG
- If the reporting person suffers a disadvantage in connection with his or her professional activity and asserts that this is a consequence of the report, it is presumedthat the disadvantage is a reprisal.
- The employer must then provethat the measure was based on sufficiently justified grounds and is not connected to the report.
4. Damages § 37 HinSchG
- In the event of a violation of the prohibition of reprisals, the perpetrator is obliged to compensation for the resulting damage (§ 37(1)).
- No claim to establishment of an employment relationship or promotion (§ 37(2)).
- In addition: invalidity of the termination under employment law, general claims.
5. Limits of protection
- No protection in the case of intentionally or grossly negligently false reporting (§ 38 HinSchG: reverse damages claim of the person affected).
- No privilege in the case of knowingly incorrect information.
Risks / typical mistakes
- Reversal of the burden of proof misjudged — under § 36(2) HinSchG the employer bears the burden of proof, not the whistleblower.
- Reprisal issued close in time to the report — a close temporal connection supports the presumption.
- Sufficient reason of the whistleblower ignored — protection also exists in the case of an objectively inaccurate but good-faith report.
- Deadline and form of employment-law counteraction (e.g. the 3-week deadline for the unfair dismissal action) missed.
- Measure without documented reasons independent of the report — the employer's evidentiary showing fails.
