About this skill

/mietrecht:mietmangel-minderung

Purpose

The reduction occurs by operation of law — it does not have to be declared. Precisely this produces the typical error constellation: the tenant reduces too much or without notification, falls into arrears and loses the apartment. This skill determines the defect, the reference base, the rate and the limits of the reduction, classifies the right of retention and self-performance, and formulates the notice of defects, on which almost everything depends in practice.

Inputs

  • Description of defect: appearance, affected rooms, start, duration, intensity, season
  • Tenancy agreement: agreed condition, statement of living area, condition at handover
  • Gross rent (base rent + advance payments) — reference base of the reduction
  • Notice of defects: date, form, proof of receipt, reaction of the landlord
  • Whether the defect was known at the time of conclusion of the contract or unknown due to gross negligence
  • Whether reduced has already been made and in what amount; payment status
  • In case of self-performance: cost receipts, status of default

Sub-agent architecture

The examination is carried in prose by specialized steps; this skill deliberately does not carry a agentsblock is deliberately omitted by this skill (mietrecht convention). A defect checker determines the contractually owed target condition and establishes the deviation — without a target condition there is no defect. An notification checker checks the notice of defects, receipt and the consequences of its omission under § 536c Abs. 2 BGB. A rate calculator determines the reference base, period and amount of the reduction. A secondary claim checker examines damages, reimbursement of expenses, self-performance and the right of retention. A risk checker mirrors the reduction made against the termination threshold of § 543 Abs. 2 Nr. 3 BGB.

Process

1. Concept of defect and target condition (§ 536 Abs. 1 BGB)

A material defect exists if the leased property is afflicted at the time of transfer with a fault that removes or reduces its suitability for use in accordance with the contract, or if such a fault arises later. The standard is the contractually agreed target condition; if an express agreement is lacking, the standard customary at the time of conclusion of the contract for the building age class is to be applied. An insignificant reduction in suitability is disregarded (§ 536 Abs. 1 S. 3 BGB). Also the absence of a warranted characteristic (Abs. 2) and legal defects (§ 536(3) BGB) are covered. An undershoot of the living area by more than 10% is a defect (BGH, judgment of 24.03.2004 – VIII ZR 295/03, https://dejure.org/dienste/vernetzung/rechtsprechung?Gericht=BGH&Datum=2004-03-24&Aktenzeichen=VIII%20ZR%20295/03); an area agreement can also come about implicitly (BGH, judgment of 23.06.2010 – VIII ZR 256/09, https://dejure.org/dienste/vernetzung/rechtsprechung?Gericht=BGH&Datum=2010-06-23&Aktenzeichen=VIII%20ZR%20256/09).

2. Symptom theory and burden of presentation

According to the symptom theory , the tenant satisfies his burden of presentation if he describes the symptom of the defect — the specific impairment according to place, time and intensity. He need neither name the cause nor assign responsibility; that is a matter for the landlord and, if applicable, the expert. A demand for rectification of a defect is therefore not incoherent merely because the tenant does not know the structural cause. Practical tip: keep a symptom log (date, time, room, measured value, photo), do not speculate about the cause.

3. Reduction by operation of law (§ 536(1) BGB)

The rent is reduced for the duration of the defect by operation of law — no declaration and no deadline are required. The reference figure is the gross rent including operating cost prepayments. The reduction takes effect from the occurrence of the defect, not only from the notification — however, late notification leads to loss under § 536c(2) BGB. Rent overpaid retroactively can be reclaimed under § 812 BGB . In the case of energy-efficient modernisation , the reduction is excluded for three months (§ 536(1a) BGB).

4. Reduction rate

The rate is measured according to the ratio of the utility value of the defective item to that of the defect-free item. It is to be estimated by the trial judge (§ 287 ZPO); so-called reduction tables are guidance aids without binding effect and may never be adopted without examination. The following must be taken into account:

  • Extent (affected area in relation to the total area),
  • Intensity (complete failure or mere impairment),
  • Duration and period (heating failure in January weighs more heavily than in July),
  • Type of use of the affected room (living/bedroom vs. storage room).

The rate is to be applied pro rata temporis if the defect did not exist for the whole month.

5. Exclusion of the reduction (§ 536b BGB, § 536(1a) BGB)

If the tenant knows of the defect at the time of conclusion of the contract, he is not entitled to the rights under §§ 536, 536a BGB. If the defect remains unknown to him as a result of gross negligence , the same applies unless the landlord fraudulently concealed the defect. If the tenant accepts the item in knowledge of the defect without reservation, he is likewise not entitled to the rights (§ 536b sentence 2 BGB) — therefore upon handover always declare a reservation and record it in the minutes. A contractual exclusion of the reduction is under residential tenancy law pursuant to § 536(4) BGB ineffective.

6. Notification of defects (§ 536c BGB)

If a defect becomes apparent in the course of the tenancy or a measure to protect the leased property becomes necessary, the tenant must notify the landlord without undue delay. If he fails to give notification, he is obliged to the landlord for compensation for the damage arising therefrom (paragraph 2 sentence 1) and loses — insofar as the landlord was unable to remedy the situation as a result of the omission — the rights to reduction, damages and termination without notice (paragraph 2 sentence 2). The notification is free of form but should be in text form with proof of receipt be made.

7. Damages and self-performance (§ 536a BGB)

Damages (paragraph 1): The landlord is liable for initial defects irrespective of fault (guarantee liability), for defects arising later only if he is responsible for them and for failure to remedy after default. Recoverable are, for example, damage to items brought in, damage to health, additional costs for alternative accommodation.

Reimbursement of expenses and self-performance (paragraph 2): The tenant can remedy the defect himself and reimbursement of the necessary expenses remedy the defect himself and reimbursement of the necessary expenses demand if

  • the landlord is with the remedy in default (No. 1) — for this a setting of a deadline is required, or
  • the immediate remedy is necessary for preservation or restoration of the leased property is necessary (No. 2) — emergency measure, no deadline required.

Anyone who commissions work himself without default and without an emergency remains stuck with the costs. An advance payment for the remedy costs may be demanded.

8. Right of retention (§ 320 BGB)

In addition to the reduction, the tenant may withhold a further part of the rent retain, in order to exert pressure on the remedy of the defect. The right of retention is temporary — the retained amount is after remedy of the defect to be paid paid additionally, unlike the reduced amount. The amount must be proportionate be; as a rough guide, three to five times the reduction amount applies. The right ceases as soon as the defect is remedied and is not applicable to periods before the notification.

9. Risk of excessive reduction (§ 543(2) sentence 1 No. 3 BGB)

If the tenant reduces too much, a payment arrears; if he reaches the threshold of § 543 para. 2 sentence 1 no. 3 BGB, termination without notice is imminent. An excusable error of law regarding the quota provides relief only in exceptional cases. Recommendation in cases of doubt: pay under reservation and subsequently reclaim the reduction amount pursuant to § 812 BGB — this separates the disputed issue from the issue of the contract's existence. Risks / typical mistakes

  • Reduced by too much — the difference is arrears of payment and can trigger termination without notice pursuant to § 543 para. 2 sentence 1 no. 3 BGB; in cases of doubt, pay under reservation.
  • Reduced from the net rent — the reference figure is the gross rent including advance payments.
  • Failure to give notice of defects or inability to prove it — loss of rights pursuant to § 536c para. 2 sentence 2 BGB and liability of the tenant for damages.
  • Reduction table adopted without verification — the quota must be estimated on a case-by-case basis; table values do not bind any court.
  • Self-remedy without default — without setting a deadline and without an emergency, there is no claim for reimbursement of expenses pursuant to § 536a para. 2 BGB.
  • Reservation missed upon handover — acceptance without reservation in knowledge of the defect leads to loss of rights pursuant to § 536b sentence 2 BGB.
  • Confusion of retention and reduction — the retained amount must be paid after removal of the defect, the reduced amount need not.
  • Investigating causes instead of describing symptoms — the symptom theory expressly does not require a statement of cause; anyone who commits to a wrong cause weakens his own submission.
