About this skill

/mietrecht:fristlose-kuendigung-543

Purpose

Termination without notice ends the lease immediately — and in practice it mostly fails on formalities: missing warning notice, incorrectly calculated arrears, incomplete statement of reasons. This skill examines the good cause under § 543 BGB, calculates the payment arrears deterministically, clarifies the effect of a grace-period payment and classifies the auxiliary ordinary termination that in practice must always be declared as well.

Inputs

  • Ground for termination: payment default / unauthorized transfer of use / substantial endangerment of the leased property / persistent disturbance of domestic peace / other
  • In the case of payment default: rent account with debits, incoming payments and allocation details; agreed due date
  • warning notices (date, content, proof of receipt)
  • termination letter (wording, signatures, date of receipt) or draft
  • Whether a grace-period payment has been made or a declaration of assumption by the social benefits provider is available
  • Whether terminated in the alternative ordinarily ; lease term for § 573c BGB

Sub-agent architecture

The review is carried in prose by specialized steps; this skill deliberately does not include a agentsblock is deliberately omitted by this skill (mietrecht convention). A arrears calculator first determines purely arithmetically which amount was outstanding as of which cut-off date and allocates payments under § 366 BGB. A elements examiner subsumes the facts under § 543(2) BGB and § 569 BGB. A warning notice examiner clarifies whether a warning notice was required and whether it stands up in terms of content and receipt. A form examiner checks written form, statement of reasons and proof of representation. A cure examiner assesses grace-period payment and set-off as well as the continuing effect on the auxiliary ordinary termination. Only the overall assessment yields the termination date.

Procedure

1. Good cause — general clause (§ 543(1) BGB)

Each party to the contract may terminate without notice for good cause . Good cause exists if, taking into account all circumstances of the individual case, in particular any fault of the parties to the contract, and weighing the interests of both sides, continuation of the lease until expiry of the notice period or until otherwise terminated cannot reasonably be expected of the party giving notice. The weighing of interests must always be carried out — even if a standard example applies.

2. Standard examples (§ 543(2) BGB)

  • No. 1 — the tenant is not granted or is deprived of the contractual use in whole or in part on time (right of termination of the tenant).
  • No. 2 — the tenant significantly violates the landlord's rights by significantly endangering the rented property through neglect of due care or leaving it to a third party without authorization.
  • No. 3 — the tenant is in default.

3. Default in payment (Section 543(2) sentence 1 no. 3 of the German Civil Code)

Two alternative sets of facts:

  • Letter a — the tenant is in default for two consecutive due dates with the payment of the rent or a not insignificant part of the rent. A not insignificant amount is arrears that exceed the rent for one month (Section 569(3) no. 1 of the German Civil Code).
  • Letter b — the tenant is in default over a period extending over more than two due dates, with the payment of rent in an amount that reaches the rent for two months .

The decisive factor is the gross rent including advance payments. Default presupposes due date and responsibility; a reminder is unnecessary where the time for performance is fixed by the calendar (Section 286(2) no. 1 of the German Civil Code). Justified reduction of rent (Section 536 of the German Civil Code) reduces the rent owed and thus the arrears — this is the tenant's most common line of defense.

4. Warning and setting a deadline (Section 543(3) of the German Civil Code)

If the important reason consists in the violation of an obligation under the lease, termination is only permissible after the unsuccessful expiry of a deadline for remedy or after an unsuccessful warning . Exceptions (paragraph 3 sentence 2): setting a deadline/warning obviously unsuccessful; immediate termination justified for special reasons after weighing the interests; default in payment under paragraph 2 no. 3 (no. 3 — a warning is unnecessary here). The warning must specifically describe the conduct complained of and announce termination; keep proof of receipt.

5. Supplementary residential tenancy sets of facts (Section 569 of the German Civil Code)

  • Paragraph 1 — significant danger to health as an important reason for the tenant, even if the tenant knew of the condition when the contract was concluded.
  • Paragraph 2 — sustained disturbance of domestic peace as an important reason for both parties.
  • Paragraph 2a — default with a security deposit under Section 551 of the German Civil Code in the amount of two months' rent.
  • Paragraph 3 no. 1 — specification of the “not insignificant part”: arrears must exceed the rent for one month.
  • Para. 4 — the ground for termination must be stated in the notice of termination.

6. Payment within the grace period (Section 569(3) No. 2 of the German Civil Code (BGB))

Termination for default in payment becomes invalid, if the landlord, at the latest by the expiry of two months after the action for eviction has become pending (lis pendens) with respect to the rent due and the compensation due under Section 546a(1) of the German Civil Code (BGB) satisfied is, or a public authority undertakes to satisfy the claim. Such cure does not occur if it was already preceded two years earlier by a payment within the grace period. Termination likewise becomes invalid if the tenant, before receipt set off and declared this without undue delay (Section 543(2) sentence 3 of the German Civil Code (BGB)).

Decisive scope: According to the case law of the Eighth Civil Division, payment within the grace period eliminates only the extraordinary (without notice), not the simultaneously declared auxiliary ordinary termination (German Federal Court of Justice, judgment of 13 October 2021 – VIII ZR 91/20, https://dejure.org/dienste/vernetzung/rechtsprechung?Gericht=BGH&Datum=2021-10-13&Aktenzeichen=VIII%20ZR%2091/20). This is the reason why in practice both terminations are always declared.

7. Form and statement of reasons (Section 568 of the German Civil Code (BGB), Section 569(4) of the German Civil Code (BGB))

The termination of a residential tenancy requires the written form (Section 568(1) of the German Civil Code (BGB), Section 126 of the German Civil Code (BGB)) — text form is not. It must be issued by all landlords to all tenants and signed; in the case of representation, the original power of attorney must be enclosed (Section 174 of the German Civil Code (BGB)). Under Section 569(4) of the German Civil Code (BGB), the ground for termination must be stated in the notice — in the case of default in payment, it is generally sufficient to state the total arrears and the payment periods. In the case of ordinary termination, reference must be made to the possibility of objection (Section 568(2) of the German Civil Code (BGB)).

8. Auxiliary ordinary termination (Section 573(2) No. 1 of the German Civil Code (BGB))

The culpable, not insignificant breach of contract is at the same time a legitimate interest for ordinary termination. It must be declared in the alternative in the same notice, so that a payment within the grace period does not invalidate the entire proceedings. The periods under Section 573c of the German Civil Code (BGB) (3 / 6 / 9 months) and the social hardship clause of Sections 574 et seq. of the German Civil Code (BGB) apply to it; cf. /mietrecht:sozialklausel-widerspruch. Unlike extraordinary termination, a warning notice is generally required here.

9. Enforcement

After expiry of the termination date, there is a claim for return under Section 546 of the German Civil Code (BGB); until return, the tenant owes compensation for use under Section 546a of the German Civil Code (BGB). On the action: /mietrecht:raeumungsklage.

Deterministic calculation

From the onset of default, the payment arrears bear interest under Section 288 of the German Civil Code (BGB) in conjunction with Section 247 of the German Civil Code (BGB). The calculator in ../../../scripts/legal_calc/ performs only the arithmetic — the onset of default, the question of consumer involvement (5 instead of 9 percentage points), and a justified reduction in rent remain legal inputs. The base interest rate is a mandatory input and must be checked against the publication of the Deutsche Bundesbank.

--json provides the calculation steps together with the citation of the statutory provision. Never enter the total arrears in the notice of termination without reconciling them with the rent account and without checking for a reduction in rent and set-off — arrears set too high make the notice of termination vulnerable to challenge.

Risks / typical mistakes

  • Arrears set too high — justified reduction in rent, set-off, or the wrong order of application of payments (Section 366 of the German Civil Code (BGB)) not taken into account; this makes the notice of termination vulnerable to challenge as a whole.
  • Warning notice missing — generally mandatory for all grounds except payment default (Section 543(3) of the German Civil Code (BGB)); also required for the auxiliary ordinary termination.
  • Auxiliary ordinary termination not declared — a payment within the grace period then renders the entire proceedings worthless.
  • Written form not complied with — email or fax are not sufficient for terminating a residential tenancy (Section 568(1) of the German Civil Code (BGB)); a missing signature of a co-landlord renders the termination ineffective.
  • Power of attorney not attached in original form — rejection under Section 174 of the German Civil Code (BGB).
  • Two-year bar on payment within the grace period overlooked — a further cure does not occur.
  • Reason for termination not stated in the letter (Section 569(4) of the German Civil Code) — supplementing reasons is only possible to a limited extent.
  • Failure to balance interests — even in the case of the standard example, Section 543(1) of the German Civil Code must be examined, in particular for long-standing tenancies and minor fault.
