Legal Statement

Important Notice:

  1. The summary must be faithful to the original text and must not add facts, opinions, or conclusions not stated in the original text.
  2. Subjective evaluative wording must not appear in the summary (such as "the court was wise," "the penalty was reasonable," "the defendant acted in bad faith," etc.).
  3. For documents in scanned or image form, OCR recognition may contain errors, and uncertainty should be noted in the summary.
  4. The summary conclusion only reflects the content contained in the document and does not represent a legal opinion on the substantive issues of the case.
  5. For cases currently under trial, the summary must not disclose procedural information or trade secrets that should not be made public.

I. Core Concepts

1.1 Comparison of Legal Document Types and Summary Focus

Different types of legal documents have different core functions and information structures, and the summary focus must be adjusted accordingly:

Document Type Core Function Summary Focus Key Elements Distinguishing It from Other Types
Judgment Resolve substantive disputes Fact finding, legal application, adjudication reasoning, judgment result The court's "finding" of facts (not the parties' claims)
Ruling Resolve procedural matters Procedural background, content of application/objection, basis for ruling, procedural conclusion Does not involve substantive disputes, only handles procedural issues
Mediation Agreement Confirm mutual agreement of both parties Matters in dispute, content of mediation agreement, performance arrangements Reflects voluntariness of both parties, not a compulsory court adjudication
Arbitration Award Final award by the arbitral tribunal Arbitration requests, fact finding, arbitral tribunal opinions, award result One-instance final award, basis of arbitration agreement
Administrative Penalty Decision Administrative sanction Illegal facts, basis for penalty, types and range of penalty Unilaterally made by an administrative organ; may be subject to reconsideration or litigation

1.2 Abstract vs. Abbreviation vs. Evaluation

原文 ──────────────────────────────────────→

  摘要:提取核心要素,结构化重组,省略非关键细节

  缩写:按比例压缩原文,保留所有信息点的精简版

  评价:加入主观判断和价值评论(摘要中禁止)

The essence of an abstract: It is not simply shortening the original text, but identifying core information, removing irrelevant details, and reorganizing information according to a logical structure.

1.3 Six-Element Extraction Framework

All legal document abstracts should be developed around the following six elements:

┌─────────────────────────────────────────────────┐
└─────────────────────────────────────────────────┘

II. Complete Workflow

Stage One: Preparation and Identification

Step 1: Identify the document type

First determine which type the legal document belongs to:

Basis for determination Judgment Ruling Mediation document Arbitral award Administrative penalty decision
Title keywords "Civil Judgment" "Criminal Judgment" "Administrative Judgment" "Civil Ruling" "Enforcement Ruling" "Civil Mediation Document" "Mediation Agreement" "Arbitral Award" "Administrative Penalty Decision"
Core function Substantive adjudication Procedural handling Confirmation of consensus Arbitral award Administrative sanction
Issuing body Court Court Court (confirming the consensus of both parties) Arbitration commission/arbitral tribunal Administrative organ

Judgment principle: One must not first apply a format and then identify the document, otherwise it is easy to miss the true focus of that type of document.

Step 2: Extract case information

Extract complete citation information from the header or title section of the document:

Extraction item Source location Example
Case name Document header Meijing Company v. Ant Company Unfair Competition Dispute
Case number/document number Below the document title (2024) Jing 0108 Min Chu No. 1234
Date End of the document December 7, 2024
Issuing institution Document header/end Beijing Haidian District People's Court
Parties Document header Plaintiff: Meijing Company; Defendant: Ant Company

Requirements: This part should preserve the original wording as much as possible to facilitate retrieval and citation.

Stage Two: Content Extraction

Step 3: Distill key facts or procedural background

According to the document type, distill the facts or procedural matters directly related to the conclusion:

Judgment/Arbitral award/Administrative penalty decision:

  • Distill facts related to the substantive dispute
  • Distinguish between "facts asserted by the parties" and "facts found in the document"
  • Retain only key facts that affect the conclusion and remove irrelevant details

Ruling:

  • Distill the procedural background (e.g., after the plaintiff filed suit, the defendant raised a jurisdictional objection)
  • Distill the application matters or the content of the objection
  • Facts not involving substantive disputes

Mediation agreement:

  • Distill the disputed matters and the background of reaching mediation
  • The main points of disagreement between the parties
  • Key factors that facilitated mediation (if mentioned)

Step 4: Summarize the focus of the dispute

Distill the dispute in the document into one or more clear legal issues:

Requirements:

  • Express as legal questions (answerable interrogative sentences)
  • Capture the issue the adjudication actually resolves
  • Avoid writing overly broad background descriptions
Poor focus of the dispute Good focus of the dispute
"The two parties had a dispute" "Whether Meijing Company's act of scraping Ant Platform data constitutes unfair competition"
"There is a dispute" "Whether the jurisdictional objection raised by the defendant is established"
"Compensation issue" "Whether the 5 million yuan in damages claimed by the plaintiff has factual and legal basis"

Step 5: Extract the conclusion or disposition result

Accurately summarize the final disposition conclusion of the document:

Document type Manner of expressing the conclusion Example
Judgment Judgment granting/supporting/dismissing/confirming/modifying "Judgment that the defendant stop the alleged unfair competition conduct and compensate the plaintiff 2 million yuan for economic losses"
Ruling Ruling granting/dismissing/transferring/suspending/terminating "Ruling to dismiss the defendant's objection to the jurisdiction of this case"
Mediation agreement The parties reached the following agreement "The parties voluntarily reached the following mediation agreement: 1. The defendant shall pay the plaintiff XX yuan before X month X day..."
Arbitration award Ruling... "Ruling that the respondent pay the applicant 1 million yuan in RMB for goods and overdue interest"
Administrative penalty decision Decide to impose... "Decide to order the party to correct the illegal act and impose a fine of 500,000 yuan in RMB"

Key principle: Accurately distinguish between "the parties' claims" and "the document's conclusion." Do not mistakenly write the plaintiff's claims as a court judgment.

Step 6: Extract the legal basis

List the legal norms cited in the document:

  • Law: Article X of the Civil Code, Article X of the Criminal Law
  • Judicial interpretation: Article X of the Supreme People's Court interpretation on...
  • Administrative regulations/departmental rules
  • Contract clauses(if a contract dispute is involved)
  • Arbitration rules(arbitration award)
  • Administrative discretion基準(administrative penalty decision)

Notes:

  • Prioritize extracting the norms directly cited by the document and used as the basis for adjudication/award/penalty
  • If the legal provisions cited in the document have become invalid or been amended, they may be noted in the summary
  • For norms referred to by "reference" or "for reference," they may be listed separately

Step 7: Summarize the reasoning process

Briefly summarize the logical process by which the conclusion was reached:

The reasoning process should show:

  1. Which facts the document adopted (the situation regarding acceptance of evidence)
  2. How to apply legal norms (statutory interpretation and application)
  3. How to respond to the main disputes and defenses (responses to opposing views)
  4. How to derive a conclusion from facts + norms (chain of logic)

Requirements:

  • Not a simple abridgement of the original text, but a demonstration of "how facts are found → how norms are applied → how the conclusion is reached"
  • Concise language, highlighting the causal chain
  • Avoid restating the complete course of the claims and defenses

Stage Three: Output

Step 8: Format the output according to the document type

Based on the identified document type, select the corresponding structured template for output (see the output format templates in Part Three).

III. Output Format Templates

Template A: General six-element summary (applicable to any legal document)

IV. Examples

Example 1: Civil judgment summary

Input (key points of the original text):

Civil Judgment of the Beijing Haidian District People's Court, (2024) Jing 0108 Min Chu No. 1234. Plaintiff Meijing Company sued defendant Ant Company for unfair competition dispute. The plaintiff alleged that the defendant Ant Company, through technical means, scraped data from the "XX Data Platform" operated by the plaintiff for use in the operation of its own products, constituting unfair competition. The defendant argued that the data it scraped was public data and that it had taken reasonable measures, so it did not constitute unfair competition. The court found: the defendant scraped the plaintiff's platform data without permission; although part of the data was public, a large amount of cost was required to collect and organize it; the defendant's conduct substantially substituted for the plaintiff's data product, harmed the plaintiff's lawful rights and interests, and disrupted the order of market competition. Judgment: 1. The defendant shall immediately stop the unfair competition conduct involved; 2. The defendant shall compensate the plaintiff 2 million yuan for economic losses and 100,000 yuan for reasonable expenses.

Input (key points of the original text):

Civil Ruling of the Beijing First Intermediate People's Court. Plaintiff Meijing Company sued defendant Ant Company for unfair competition dispute and filed the lawsuit with the Haidian District Court. During the period for filing a defense, the defendant raised an objection to jurisdiction, arguing that this case should be under the jurisdiction of the court at the defendant's domicile (Chaoyang District, Beijing). After review, the Haidian District Court held that this case was an unfair competition dispute and that the court at the place of the tort (Haidian District) had jurisdiction, and ruled to reject the defendant's jurisdictional objection. The defendant was dissatisfied and appealed. After review, the First Intermediate Court held that the tort alleged by the plaintiff occurred in Haidian District, and the Haidian District Court, as the court at the place of the tort, had jurisdiction over this case. Administrative Penalty Decision of the Beijing Municipal Market Supervision Administration. Party: a certain technology company. Upon investigation, the party, in the App it operates, collected users' clipboard information without users' consent, for the purpose of identifying users' source channels. This conduct violated Articles 13 and 16 of the Personal Information Protection Law. The party argued in its defense that it collected the information to optimize user experience and that it had adopted anonymization processing. V. Common Errors and Prevention

Error Type Error Description Consequence Preventive Measures
Document Type Misidentification Summarizing a ruling in the format of a judgment, extracting substantive disputes at length The focus of the summary is completely off, and the true procedural focus is omitted First identify the document type, then select the corresponding template
Confusing claims with findings Writing the facts claimed by the plaintiff as "facts found by the court" The summary is inaccurate and misleads the reader Strictly distinguish "claims of the parties" from "findings of the document"; the latter must be cited with its source
The issues in dispute are too broad "The two parties had a dispute" "There is a controversy" Cannot reveal the legal issues that the case truly needs to resolve State the issues as answerable legal questions
Subjective evaluations mixed in "The court wisely held" "The penalty was very reasonable" Violates the principle of objectivity and neutrality in summaries Delete all evaluative adjectives and state only facts and conclusions
Retelling rather than summarizing Quoting large passages of the original text with only simple deletions Loses the value of a summary and makes it lengthy Extract the core elements and reorganize them in summarizing language
Omitting the legal basis Writing only "according to relevant legal provisions" Cannot trace the normative basis of the adjudication/penalty List the specific legal provisions cited in the document one by one
The reasoning process is empty "The court made a judgment according to law" The logical chain is not shown, and the reader cannot understand how the conclusion was reached Show the complete chain of "fact-finding → application of norms → derivation of conclusion"
Ignoring procedural boilerplate Retaining large amounts of service process, hearing notices, and composition of the collegial panel The length expands and the core information is drowned out Compress or omit procedural content that has no effect on the conclusion

VI. Handling Special Scenarios

6.1 Cases with Multiple Defendants/Multiple Plaintiffs

  • Clearly list the litigation status of all parties in the "Parties" section
  • Distinguish the different claims and conduct of each party in the "Case Facts"
  • List separately the handling of each party in the "Adjudication Result"

6.2 Series Cases/Related Cases

  • Indicate at the beginning of the summary the relationship between this case and related cases
  • If the judgment result of this case depends on the judgment in another case, this should be explained
  • If it involves mass litigation (such as a series of securities misrepresentation cases), common facts may be simplified and individual case differences highlighted

6.3 Second-Instance/Retrial Documents

  • Summary of a second-instance judgment: Focus on extracting the differences between the first-instance findings and the second-instance reversal/affirmance, and the reasons for the second-instance court's reversal
  • Summary of a retrial document: Focus on extracting the reasons why the party applied for retrial and the court's review conclusion on the original trial
  • Explain the trial levels the case went through in the "Procedural Background"

6.4 Scanned/OCR-Recognized Documents

  • If there are characters whose recognition is uncertain, use in the summary[?]Mark
  • Key figures (amounts, dates, case numbers) should be specially flagged if they cannot be clearly identified
  • It is recommended that users verify against the original text, especially the article numbers of legal bases

6.5 Foreign-related/Hong Kong, Macao and Taiwan cases

  • Pay attention to identifying the applicable law (Chinese law, foreign law, international treaties)
  • If conflict-of-laws rules are involved, the applicable law chosen by the court should be explained
  • For procedural issues such as extraterritorial service and extraterritorial evidence collection, focus on extracting them in the ruling

6.6 Class actions/representative actions

  • In the "parties" section, explain the litigation representative and the represented plaintiff group
  • Summarize the common factual basis in the "case facts"
  • Explain the scope of effect of the judgment in the "judgment result"

VIII. Related Skills

Related Skills Relationship Description
Legal document formatting Complementary Ensure the summary output format is standardized and the layout is neat
Legal provision retrieval Upstream/parallel Verify the current validity of the legal bases extracted in the summary
Legal reasoning Downstream Further analyze the reasoning logic and argumentation structure on the basis of the summary
Understanding of legal concepts Upstream Understand the key legal concepts involved in the summary (such as "public order and good morals" and "good faith")
Similar case retrieval and analysis Downstream Compare and analyze after summarizing multiple documents
Multi-document summarization Extension When batch summarization and comparison of multiple documents are needed

IX. Limitations and Risk Warnings

  • Dependence on information completeness: Summary quality depends entirely on the completeness and clarity of the original information. If the original text is logically confused or insufficiently reasoned, the summary cannot compensate for it.
  • OCR recognition risk: OCR recognition of scanned copies may contain errors in text, numbers, and punctuation. When key information is involved, users should be advised to verify against the original text.
  • Subjective understanding bias: Although summaries are required to be objective and neutral, the selection of "key facts" and the distillation of "points of dispute" inevitably involve judgment, and different people may have different emphases.
  • Format limitations: Standardized templates cannot cover all special types of documents. When encountering new or uncommon documents, flexible adjustments should be made on the basis of the general six-element framework.
  • Timeliness: The timeliness of legal bases is based on the time the document was issued. Legal provisions cited in the summary may have been subsequently amended. If they are to be used for current legal analysis, they should be verified separately.
  • Confidential information: For cases involving closed hearings, trade secrets, or personal privacy, the summary should comply with information disclosure restrictions and, when necessary, desensitize sensitive information.
