Overview
This is a specialized skill that systematically analyzes patent data to produce technology trends, prior art reports, FTO (Freedom-to-Operate) analyses, and patent application drafts. It performs in-depth analysis based on patent data retrieved with the moai-lawyer:legal-patent-search skill.
Trigger Keywords
- patent analysis, patent trends, patent map
- prior art search, prior art search
- FTO analysis, infringement analysis, claim scope analysis
- patent application, specification drafting
- technology roadmap, IPC analysis
Workflow
Step 1: Confirm analysis purpose
Use AskUserQuestion to have the analysis purpose selected:
| Analysis Type | Description | Deliverables |
|---|---|---|
| Patent trend analysis | Filing trends by technology, major applicants, IPC distribution | Patent trend report (including charts) |
| Prior art search | Search and analysis of related patents by key component of the invention | Prior art search report |
| FTO analysis | Determination of infringement possibility compared with registered patent claims | FTO analysis report |
| Application draft | Organize the invention content in patent specification format | Patent application draft |
Step 2: Collect patent data (if needed)
If there is no patent data to analyze, search by linking with the moai-lawyer:legal-patent-search skill:
- Search keywords and IPC classification codes
- Search scope (domestic/overseas, year, status)
- Purpose of data collection (trends/prior art/FTO)
Step 3: Perform analysis
A. Patent Landscape Analysis
-
Analysis of filing trends by year
- Long-term trends in 5-10 year units
- Identify technology life cycle stage (introduction/growth/maturity/decline)
-
Competitive status by applicant
- Number of filings and share of top 10 applicants
- Analysis of major applicants' technology portfolios
-
Technology map by IPC/CPC classification
- Technology distribution by major category
- Identify core technologies by detailed field
-
Visualization (linked with moai-analyst:data-visualizer skill)
- Chart of filing trends by year
- Pie chart of share by applicant
- IPC distribution treemap
B. Prior Art Search
-
Extract key components of the invention
- Technical problem of the invention
- Key components by solution means
- Keyword and IPC mapping by component
-
Related patent search (linked with moai-lawyer:legal-patent-search skill)
- Individual search by component
- Combination search (AND of 2 or more components)
- Exclusion search (emphasizing differentiators)
-
Similarity analysis and derivation of differentiators
- Matching components against claims
- Identifying differentiators from prior art
- Novelty/inventive step assessment
-
Preparing prior art search report
- Search strategy (keywords, IPC, search queries)
- Related patent list (5-10 most similar cases)
- Component comparison table against claims
- Opinion on differentiators and novelty/inventive step
C. FTO analysis (Freedom-to-Operate)
-
Identifying registered patents subject to analysis
- Searching registered patents related to the target technology
- Filtering patents related to claim scope examination
- Prioritizing review of competitor patents
-
Claim analysis (focused on independent claims)
- Interpreting requirements for each component of independent claims
- Component-by-component comparison (All Element Rule)
- Reviewing applicability of the doctrine of equivalents
-
Determining likelihood of infringement
- Direct infringement (including all components)
- Indirect infringement (supplying parts/software)
- Joint infringement (joint execution)
- Infringement under the doctrine of equivalents (when the doctrine of equivalents applies)
-
Proposing design-around directions
- Presenting non-infringing alternative components
- Assessing possibility of invalidation trial
- Reference points for license negotiations
-
Preparing FTO analysis report
- List of patents subject to analysis
- Component comparison table against claims
- Comprehensive opinion on likelihood of infringement
- Risk rating (High/Medium/Low)
- Design-around measures
D. Drafting the application
-
Title of the invention
-
Technical field
- Technical field to which the invention pertains
-
Background art
- Problems of the existing technology
- Problem to be solved
-
Summary of the invention
- Means for solving the problem (core components)
- Operational effects of the invention
- Embodiments (preferred forms)
-
Claims
- Independent claims (core components required)
- Dependent claims (additional components)
- Functional expression for each component
-
Abstract
- Summary of the invention (around 200 characters)
-
Brief description of drawings (if drawings are present)
Step 4: Report preparation
Prepare the following reports according to the purpose of analysis:
- Patent trend analysis report (including charts)
- Prior art search report
- FTO analysis report
- Draft patent application
Step 5: Review and proposal
- Comprehensive evaluation of the analysis results
- Proposed follow-up actions (filing/invalidation trial/licensing, etc.)
Usage examples
"배터리 기술 특허 동향을 분석해줘. 최근 10년 기준으로."
"이 발명의 선행기술을 조사해줘. 핵심 구성요소는 A, B, C야."
"FTO 분석을 해줘. 대상 기술은 'AI 기반 이상 탐지'야."
"특허 출원서 초안을 작성해줘. 발명의 명칭은 '양자 암호 통신 방법'이야."
Output format
- Patent trend analysis report (Markdown + charts)
- Prior art search report (Markdown + comparison table)
- FTO analysis report (Markdown + risk rating)
- Patent application draft (Markdown)
Precautions
- Prior art searches and FTO analyses should be reviewed by a qualified patent attorney.
- FTO analysis targets registered patents, and for pending applications, the scope of rights is finalized after registration.
- The application draft is for reference only, and must be reviewed by a patent attorney before actual filing.
- If patent data is insufficient, it is recommended to first run the moai-lawyer:legal-patent-search skill to collect data and then perform linked analysis.
- If visualization is needed, charts can be generated by linking the moai-analyst:data-visualizer skill.
Related skills
- moai-lawyer:legal-patent-search - Patent search and bibliographic information collection
- moai-analyst:data-visualizer - Patent trend visualization (yearly trends, IPC distribution charts)
- moai-tutor:education-grant-writer - Drafting the prior art section of a research grant application
Post-processing chain (body/narrative deliverables)
After writing narrative text such as prior art search reports, FTO analysis reports, and patent application drafts, finish with the following chain:
legal-patent-analyzer → moai-coworker:ai-slop-reviewer → moai-writer:korean-humanize → 최종 검수
- moai-coworker:ai-slop-reviewer - AI pattern review and post-processing of the written report/application
- moai-writer:korean-humanize - Korean sentence naturalization (removing AI-ness, preserving meaning)
Data/table/chart deliverables such as yearly filing trends, IPC distribution, and applicant share are not subject to this chain, and visualization is routed to moai-analyst:data-visualizer(for mixed deliverables, the chain applies only to the narrative portion).
Disclaimer
The patent analysis, prior art search, FTO analysis, and application drafting performed by this skill are for reference only. Actual patent filing, FTO determinations, and interpretation of the scope of rights must be reviewed by a patent attorney.
