Purpose
Creation of professional legal opinions with academic depth of analysis, multi-level argumentation, and a solid doctrinal foundation.
Structure of the opinion
Mandatory sections
- Title page: title, author (degree, position), date, place
- Description of the situation: numbered points, chronology, key facts
- Questions: clearly formulated legal questions
- Brief answers: summary of conclusions (1–2 paragraphs per question)
- Detailed answers: full argumentation in sections A, B, C...
- Footnotes: bibliography in academic format
Principle of multi-level defense
Support each thesis with several alternative arguments:
- Main argument (if accepted — the case is won)
- Subsidiary argument (if the main one is rejected)
- Fallback argument (if both previous ones fail)
Formulation: "Even if one considers that [counterargument], then [alternative contention]..."
Methodology of argumentation
Doctrinal foundation
Build argumentation on authoritative sources:
- Classical civil law (German, French schools)
- Pre-revolutionary Russian doctrine
- Soviet civil law school
- Contemporary Russian scholars
- Current judicial practice (Supreme Court of the Russian Federation, Constitutional Court of the Russian Federation)
Structure of the argument
- Thesis: clear formulation of the position
- Theoretical justification: doctrinal sources
- Normative confirmation: references to articles of codes
- Practical reinforcement: judicial acts
- Logical conclusion: conclusion for a specific case
Working with competing theories
In the presence of scholarly debate:
- Present both positions objectively
- Show the history of the development of the dispute
- Indicate the prevailing point of view
- Justify the choice of position for the conclusion
Stylistic requirements
Terminology
- Use precise legal terms
- Latin terms in italics: res judicata, ius exceptionis
- Consistency: use the chosen term uniformly
Syntax
- Sentences: no more than 35 words
- Avoid chains of introductory constructions
- One idea — one paragraph
Formatting
- Hierarchical numbering of sections (I, II, III → A, B, C → 1, 2, 3)
- Section headings — theses ("Claims for recognition are not subject to limitation")
- Footnotes at the bottom of the page with full bibliographic data
