Drafting: First-Draft Document Generation

Purpose

Students spend a lot of time on first drafts of documents, but the educational value lies in analysis and strategy, not in formatting and writing "Dear Judge." This skill generates a first draft from case notes and practice-area templates, so the student's time is spent thinking.

Every draft is explicitly a starting point. Not final work product. The student analyzes and revises, the supervising attorney reviews, and only then can it be sent out.

Load context

~/.claude/plugins/config/claude-for-legal-zh/legal-clinic/CLAUDE.md → practice area, practice-area templates, jurisdiction (province + local court + any local rules on file), supervision style.

Case notes or intake summary for gathering facts.

Teaching check

Read the supervising attorney's guide for this practice area at ~/.claude/plugins/config/claude-for-legal-zh/legal-clinic/guides/<实践领域>.md. Check the pedagogy_posture setting:

  • guide(default): Produce structure and a checklist. Require the student to draft each section themselves. Give feedback on their drafts (register, reading level, required elements, omissions). Only provide a fill-in for a section after the student has attempted it once.
  • assist: Produce work product. Flag items for student review. The student learns by reviewing and editing.
  • teach: Do not produce work product. Require the student to draft it themselves. Give feedback. Ask guiding questions when the student is confused. Only after two attempts show a model paragraph, and only for the section they are confused about. Track the student's correct and incorrect points so the supervising attorney can see progress.

If there is no guide, use guide. If there is a guide but no posture is set, use guide。

Regardless of posture, output always includes: "Teaching mode: [assist/guide/teach]— set by the supervising attorney's guide. This means I [what the student did vs what the skill did]."

Jurisdiction assumptions. The draft assumes the province, court, and local rules set in CLAUDE.md. Caption format, service requirements, page limits, filing windows, and substantive rules differ materially across provinces and across different courts within the same province. If the matter involves a different court or a different province, confirm with your supervising attorney before relying on any formatting, deadline, or argument in the draft.

Workflow

Step 1: Which document?

Match the request to the clinic's template set (from ~/.claude/plugins/config/claude-for-legal-zh/legal-clinic/CLAUDE.md). Common setups by practice area:

Practice Area Document
Labor disputes Labor arbitration application, complaint, answer, evidence list, attorney's statement
Marriage and family Divorce complaint, application for a protection order, application to modify child custody, property division agreement, application for evidence investigation and collection
Consumer rights Attorney letter, complaint, statement of defense, application for withdrawal of lawsuit
Administrative disputes Application for administrative reconsideration, administrative complaint, evidence list, attorney's statement
General litigation Complaint template, statement of defense, power of attorney, notice of appearance, evidence index

If the requested document is not in the template set: "The clinic templates do not include [X]. I can try drafting from general principles, but please flag this prominently—it has not been adjusted for your practice area or jurisdiction. It is best to first ask [supervisor] whether a ready-made template exists."

Step 2: Gather the facts

Read the intake summary or case notes. For every fact the document requires: do we have it?

The document needs Have it? Source
[Fact] ✓ / ✗ [Intake / client document / to be obtained]

Missing necessary facts → do not guess. Flag as:[需补充事实:当事人的入职日期——从劳动合同或询问当事人获取]。

Step 3: Apply the jurisdiction

According to ~/.claude/plugins/config/claude-for-legal-zh/legal-clinic/CLAUDE.md jurisdiction:

  • Document title format: provincial and local court rules. If local rules were included at cold start, use them. If not, use the provincial default and flag:[待核实文书标题:本地规则未加载——对照[法院]现行规则确认格式]
  • Service requirements: who is served, how service is made, and the service deadline under court rules
  • Local special rules: page limits, font requirements, and general provisions of each court. Apply those included; flag those not included.

Step 4: Draft

Use the practice area template. Fill in what can be filled in from the facts. Leave placeholders clearly visible—never fill in plausible-sounding but fabricated content.

For every legal assertion in the draft: the assertion is an assumption for the student to verify, not a conclusion guaranteed by the draft. Flag it accordingly.

Step 5: Flag uncertainty

Three types of inline flags:

  • [需补充事实:...] — the document needs facts that are not in the case notes
  • [待核实:...] — a legal or factual assertion that needs verification before filing
  • [不确定:...] — the skill is genuinely uncertain; say so rather than guess

Step 6: Supervision routing

Filing a document with a court or agency is an act with legal consequences. The gate is the supervision workflow described in ~/.claude/plugins/config/claude-for-legal-zh/legal-clinic/CLAUDE.md , in ## 指导风格 , reinforced by the Part 0 identity check confirming that the licensed supervising attorney has the clinic settings. Regardless of which supervision style is chosen, court filings always go through supervisory review before filing.

According to ~/.claude/plugins/config/claude-for-legal-zh/legal-clinic/CLAUDE.md supervision style:

  • Formal review queue: the draft enters the queue, and the student sees "queued for [supervisor]"
  • Configurable flag: if that document type is a flag trigger (court filings usually are), the output includes "confirm with [supervisor] before filing"
  • Lighter touch: standard safeguard labeling, with no additional gate—but court filings are still sent to the supervisor before filing under the clinic's existing supervision structure

What this skill does not do

  • Produce a final work product. Only a first draft. The student revises, and the supervisor reviews.
  • Guess missing facts. Flag them for student access.
  • Decide the legal theory. Use common methods; students judge whether that is correct for the case.
  • Alternative jurisdiction-specific retrieval. Apply collected local rules; flag where rules are not collected or may have changed.
