This is a preliminary search, not a trademark clearance legal opinion. A trademark clearance legal opinion requires a full professional search and the judgment of a practicing trademark attorney. A "no obvious conflicts found" result means this preliminary search found nothing—it does not mean the trademark is conflict-free. Clients have been sued over trademarks that passed a knockout search.
Instructions
- Read
~/.claude/plugins/config/claude-for-legal-zh/ip-legal/CLAUDE.md. If it contains[占位符], stop and direct to/ip-legal:cold-start-interview。 - Follow the workflow below.
- Run intake (trademark, goods/services, classes, jurisdiction, visuals/stylization).
- Knockout screening for inherent obstacles—generic terms, descriptiveness, deceptiveness, geographic names, surnames, false association, prohibited matters, functionality.
- Conduct a similar mark search against connected search tools (CNIPA trademark database, or any available MCP). If none are connected, state so in the output, and perform factor analysis only.
- Analyze each likelihood of confusion factor item by item—under the confusion standard of Article 57 of the Chinese Trademark Law. Flag each one; never reach a conclusion.
- Write the preliminary search memo to the matter folder (if there is an active matter) or the practice output folder. Header it as work product according to role.
- End with recommended next steps and a non-attorney gate (if the role is non-attorney).
This skill never reaches a conclusion that a trademark is conflict-free. If uncertain, flag it—the attorney decides.
Examples
/ip-legal:clearance "APEXLEAF 户外服装产品线,计划在中美欧上市"
/ip-legal:clearance
(The skill will ask for the trademark, goods, classes, and jurisdiction.)
This is a preliminary search, not a trademark clearance legal opinion
Say this sentence at the top of every output. Do not omit it. Do not soften it.
This is a preliminary search, not a trademark clearance legal opinion. A trademark clearance legal opinion requires a full professional search (CNIPA trademark database, local business registration, domain name and social media searches, design searches, etc.) as well as an attorney's judgment on likelihood of confusion, which depends on factors that a structured preliminary search cannot fully assess. This skill's "no obvious conflicts found" result means this preliminary search found nothing—it does not mean the trademark is conflict-free. Clients have been sued over trademarks that passed a knockout search. A practicing trademark attorney evaluates before anyone adopts, applies for, or invests in the trademark.
This is the loudest guardrail in the plugin. Underestimating conflicts is a one-way street—signage on trucks, products already on the market, filed trademark applications, with problems buried underneath. Overestimating is a two-way street—the attorney narrows the list during review. Stay on the two-way street side.
Matter Context
Matter context. Check the practice-level CLAUDE.md for ## 事项工作区. If 已启用 is ✗(the default for legal users), skip this section—the skill uses practice-level context, and the matter mechanism is not visible. If it is enabled and there is no active matter, ask: "Which matter is this? Run /ip-legal:matter-workspace switch <代号> or say 实践级." Load the active matter's matter.md to get matter-specific context and overrides. Write output to the matter folder ~/.claude/plugins/config/claude-for-legal-zh/ip-legal/matters/<代号>/. Unless 跨事项上下文 is 开启, otherwise never read files on other matters.
Load the practice profile first
Before clearing the search, read ~/.claude/plugins/config/claude-for-legal-zh/ip-legal/CLAUDE.md. Extract:
- Rolefrom
## 谁在使用(lawyer vs. non-lawyer changes the work product header and the non-lawyer gate below). - Registered jurisdictionandenforcement jurisdictionfrom
## IP实践档案and## 执法姿态(default jurisdiction when the user does not specify). - Integrationsfrom
## 可用集成—determines which searches are available, what the fallback options are, and the source annotations in the output. - Decision stancefrom
## 对主观法律判断的决策立场—this skill never reaches a conclusion of "no likelihood of similarity/no likelihood of confusion."
If the configuration file contains [占位符] or [你的公司名称], pop up this prompt:
I notice you have not yet configured a practice profile—I use it to tailor the stance, jurisdiction, and approval chain.
Two options:
- Run
/ip-legal:cold-start-interview(2 minutes) to configure the profile, and then I will tailor it to your practice.- Say "provisional mode" and I will use generic defaults—China jurisdiction, medium risk preference, lawyer role, no playbook—and mark every output as
[临时模式 — 请配置实践档案以获取定制输出]。
Provisional mode
If the user says "provisional mode," use the generic defaults to search normally: medium risk preference, lawyer role, China jurisdiction (CNIPA + Trademark Law), no playbook. Mark the review notes and every finding with [临时模式]. Append the prompt at the end of the output.
Intake
Ask all at once (do not drag out a quick job):
A few questions before the search:
- Proposed trademark. Exact spelling, any stylization, and whether it is a word mark, figurative mark, or composite mark.
- Goods or services. What is actually sold or provided under the trademark. One or two sentences—I will map it to the Nice Classification.
- Classes. If the Nice Classification classes are known, list them. Otherwise describe the goods/services, and I will suggest possible classes and confirm with you.
- Jurisdictions. In which jurisdictions do you plan to use, register, or enforce? (Mainland China / Hong Kong / Macau / Taiwan / Madrid—if unspecified, the default from the practice profile is used:
注册地。)- Presentation in use. Any slogan, adjacent product name, trade dress, or visual elements that will appear together in the market.
Wait for the answer. If the description is vague ("AI tool" "platform"), ask one follow-up:
Tell me what the customer actually sees—is it a consumer mobile app, an enterprise API, a physical product, or a service? The class depends on this.
Exclusion screening (inherent obstacles)
Before running any database search, first check for inherent obstacles that would be sufficient to reject the trademark regardless of whether there are prior registrations. Assess each plainly and flag it. Do not gloss over or downplay obvious obstacles.
Under Chinese trademark law, the main inherent obstacles [法条原文]:
| Obstacle | Meaning | When to flag |
|---|---|---|
| Generic name(Trademark Law Article 11, Paragraph 1, Item 1) | The word itself belongs to that category (e.g., "soap" for soap) | The mark names what the item is |
| Descriptive(Trademark Law Article 11, Paragraph 1, Items 2-3) | Directly describes characteristics, functions, quality, or raw materials | Consumers know what the product does upon reading the mark without needing to imagine |
| Deceptive(Trademark Law Article 10, Paragraph 1, Item 7) | Makes misleading statements about substantive characteristics | The mark implies qualities the goods do not possess, and such qualities would affect purchasing decisions |
| Geographic name(Trademark Law Article 10, Paragraph 2 / Article 16) | The mark is primarily a place name, and the goods come from (or do not come from) that place | Mark = place name + generic name; or place name + goods where consumers would assume the place of origin |
| Contains only a surname(Trademark Law Article 11, Paragraph 1) | The mark is primarily a surname | Reads to the relevant consumers as someone's surname |
| False association(Trademark Law Article 10, Paragraph 1, Items 5-6) | The mark falsely implies an association with a person, organization, or national symbol | The mark references an identifiable specific person or organization |
| Prohibited items(Trademark Law Article 10) | National flags, national emblems, military flags, medals, etc. | The mark contains prohibited elements |
| Lack of distinctive character(Trademark Law Article 9 + Article 11) | Lacks distinctive character as a whole and cannot distinguish the source of goods | The relevant public cannot recognize it as a trademark |
| Functionality(Trademark Law Article 12 — three-dimensional marks) | The feature is necessary for use or affects cost/quality | Three-dimensional mark — the feature serves a functional purpose |
Output: For each obstacle category, either "no obstacle found" or a specific annotation with one line of reasoning. Do not output a blank table where everything passes.
Similar trademark check
The purpose isto find prior trademarks that may constitute similarity, not to determine whether confusion is constituted. That is the lawyer's judgment.
What the user has connected
Read ## 可用集成:
- If a trademark search connector is available(China National Intellectual Property Administration trademark search, or any MCP that exposes trademark search): run a preliminary search across relevant classes and jurisdictions. Attribute each result to its source. Note the search date and scope.
- If a legal research connector is available: search for reported disputes involving the trademark or similar variants. Same attribution rules.
- If no search connector is available: State this explicitly in the output. Do not infer results from model knowledge and present them as search findings.
Fallback when there is no database access
Write the following exact statement in the output:
No database search was run. This initial check did not access the China National Intellectual Property Administration trademark database, the WIPO Global Brand Database, or any other prior rights source. A full professional search must be conducted before drawing any conclusion about availability. The following initial check is limited to inherent obstacle analysis and structured confusion factors for trademarks identified by the user or appearing in the conversation.
Then continue — the inherent check and factor analysis are still useful, just labeled truthfully.
For each similar trademark found (or provided by the user)
Record:
- Trademark(exact text, any stylization)
- Source(CNIPA registration number, Madrid designation number, domain name, social media account — any one)
- Class / goods and services descriptionfrom the register
- Proprietor
- Status(registered / under examination / lapsed / cancelled — dead trademarks are not obstacles but are relevant to fame and prior rights)
- First use date (if any)
Do not silently supplement. If citing a CNIPA registration number, it comes from a search you ran; if describing a trademark mentioned by the user, say so. Never fabricate registration information, and never "fill in" details when the record does not support them.
Likelihood of confusion factors (Article 57 standard of the Trademark Law)
The confusion framework is jurisdiction-specific. China assesses likelihood of confusion under Article 57 of the Trademark Law and the standards established by the Interpretation of the Supreme People's Court on Several Issues Concerning the Application of Law in the Trial of Civil Dispute Cases Involving Trademarks. Unlike the multi-factor test in the United States (du Pont et al.), Chinese courts comprehensively consider the following factors
[法条原文]:
- Degree of similarity of the trademarks(shape, sound, meaning and overall commercial impression) — according to the similarity determination standards in the Trademark Examination and Adjudication Guidelines
- Degree of similarity of the goods/services— according to the Classification Table of Similar Goods and Services and relevant judicial interpretations
- Distinctiveness and fame of the prior trademark— fanciful/arbitrary/suggestive/descriptive/generic, as well as evidence of fame
- Degree of attention of the relevant public— ordinary consumers vs. professional purchasers
- Evidence of actual confusion— if any
- Subjective intent— whether there is an intent to free ride on the goodwill of others
- Other relevant factors
For each factor, produceannotations, not determinations. Each factor should state what is on each side and where the uncertainties lie. According to the decision posture in the practice file:
- Never conclude that there is "no likelihood of confusion."
- If uncertain, write: "Similar trademark found — a confusion assessment is required before adoption."
- "No similar trademark found in the databases searched" only when a search was actually run — see the no-search fallback above.
Recommended next steps
Every clearance search output ends with concrete next steps, grouped by what the initial check found:
- If an inherent obstacle is found: Rethink the trademark, or accept the descriptiveness limitation and plan to acquire distinctiveness over time; route to attorney review before adoption.
- If a similar trademark is found in the databases searched: Must be reviewed by a lawyer before adoption, filing an application, or marketing. The usual next step is a full professional search to find everything this preliminary check missed.
- If no similar trademarks were found but no database search was run: A full search must be conducted before adoption. List the databases that need to be queried.
- If similar trademarks were found but the prior marks are weak, old, in different classes, or have lapsed: Flag for lawyer review—this preliminary check does not make that determination.
- Always: A full clearance legal opinion issued by a practicing trademark attorney, with depth matching the investment the trademark will carry.
Output Format

Non-Lawyer Gate
Before emitting output, read ## 谁在使用. If the role is non-lawyer:
This output is a research preliminary check, not legal advice. Adopting, filing an application for, or investing in this trademark based solely on this preliminary check has legal consequences— including being sued for infringement because of a trademark that "passed" this check. A practicing trademark attorney needs to assess this beforehand.
Below is a brief for taking to a lawyer—it can shorten the time the conversation requires: [Generate a 1-page summary: proposed trademark, goods/services and classes, inherent obstacles (if any), similar trademarks that appeared (if any), what was searched and what was not, and three questions to ask the lawyer.]
If you need to find a practicing attorney or other authorized legal professional: through your local bar association or the judicial bureau's lawyer lookup system is the fastest starting point.
Deliver the full preliminary check memo together with the brief. Do not withhold the analysis.

What This Skill Does Not Do
- Conclude that a trademark is conflict-free. Never. The loudest guardrail in the plugin.
- Replace CNIPA trademark database searches, domain and social media searches, international searches, or design trademark searches.
- File trademark applications. Filing an application is a lawyer's task; this skill informs the filing decision.
- Assess trademark dilution or well-known trademark claims beyond preliminary flagging.
- Cite the output to clients, opposing parties, or the media. This is internal research. If the top header applies, it is a confidential document.
