Legal Document Section Drafting

Purpose

A good document section is consistent with the theory, has file citations, is written in the internal style, and is verifiable. This skill produces a first draft—the focus is on thedraft. The lawyer revises and finalizes.

Written or oral?

Ask before drafting: "Is this for written submission or oral argument?" They are different crafts:

  • Written: Complete. Cover the points, develop the legal basis, anticipate responses.
  • Oral: Strategic. Choose the 3-4 most important points. Drop the weak ones. Start with the strongest.

Record fidelity—citations and pinpoint cites

Verbatim quotes must be verbatim. Do not put quotation marks around the words of opposing counsel, witnesses, the court, or any file document unless you have the exact passage and can cite to it.

Pinpoint cites must support the entire proposition. If the argument is "the other side said X, Y, and Z" and you cite a pinpoint, verify that the pinpoint supports X and Y and Z.

Candor about weak arguments

When the law is against you, say so. When an argument is weak—the legal basis points the other way, the facts do not support it, the inference is strained—do not build a shaky argument and present it as solid. Flag it:

"This argument is weak—[legal basis] points the other way. Consider whether to advance it (framed this way), concede and pivot to [stronger argument], or drop it.[需审查——策略性决定]。"

Load Context

~/.claude/plugins/config/claude-for-legal-zh/litigation-legal/CLAUDE.md → case theory, internal style (citation format, structure, tone).

Workflow

Step 1: Which section?

Section Function Required Input
Facts and grounds (complaint/defense) Tell the story in your own framework, cite the file Chronology, key documents
Argument Present legal arguments Issues, legal basis, facts
Appeal request Request relief What you want
Grounds for appeal Point out errors in the original trial Original judgment, new evidence
Application for retrial Point out errors in the effective judgment Effective judgment document, new evidence

Step 2: Theory check

Before writing: what does this section need to accomplish for the theory?

If the section about to be drafted contradicts the theory—stop. Either the theory is wrong or the section approach is wrong. Flag it, do not gloss over it.

Step 3: Draft in the internal style

Follow ~/.claude/plugins/config/claude-for-legal-zh/litigation-legal/CLAUDE.md:

  • Citation format: Normalization of legal provision citations (full name + article number). Normalization of case citations.
  • Structure: How should the arguments be organized? Conclusion first or developed step by step?
  • Tone: Aggressive or restrained? Match the law firm/legal department style.
  • Chinese legal document standards: Complaints, statements of defense, attorney's statements, and appeals each have statutory formatting requirements.

Step 4: Cite everything

Every fact → case file citation (evidence number, page number). Every legal proposition → legal provision citation with precise article number.

Marking conventions—use extensively:

  • [需核实:具体事实主张] — anything not verified against the case file
  • [不确定:具体法律命题] — anything not verified against the current legal basis
  • [需要引用:具体引用——事实/规则相信存在但引用尚未精确定位]

Step 5: Output

Section draft, in internal style, inline markup.

What this skill does not do

  • Produce a final document. It produces a draft. Every citation needs verification, every argument needs lawyer review.
  • Decide strategy. If there are two ways to argue, mark both and let the lawyer choose.
  • Submit anything. Never.
