About this skill

/sportrecht:vereinsrechtliche-sanktion

Purpose

The skill examines the formal and substantive legality of a club or association sanction and drafts the appropriate legal remedy — within the association (appeal), before an arbitral tribunal (CAS / DIS Sports Arbitration Tribunal) or before a civil court (action for annulment before the Regional Court under § 32 BGB / § 246 German Stock Corporation Act [AktG] by analogy). It also covers the special civil-law form of stadium ban (§ 858, § 1004 BGB in conjunction with the Federal Constitutional Court's [BVerfG] third-party effect of Art. 3 of the Basic Law [GG]).

Inputs

  • Type of sanction (expulsion, ban, fine, stadium ban, withdrawal of title/points)
  • Sanctioning body (club, state association, national association)
  • Text of the articles of association and procedural rules (relevant extract)
  • Procedural history (hearing? written reasons? notice of legal remedies?)
  • Membership / licence / athlete agreement with arbitration clause?
  • Date of the sanction decision (start of the time limit!)
  • Previous escalation (appeal already lodged within the association?)

Sub-agent architecture

Researcher provides BGB club-law provisions, Federal Court of Justice [BGH] case law on judicial review of the content of club articles of association and on stadium bans, BVerfG case law on the third-party effect of fundamental rights, as well as Reichert/Sauter-Schweyer-Waldner. Drafter either drafts an action for annulment (Regional Court, § 32 BGB / § 246 AktG by analogy) or an internal association complaint / arbitration action depending on the stage of proceedings. Reviewer checks the right to a hearing (BLOCKER), the definiteness of the provision in the articles of association, the validity of the arbitration clause (Pechstein line) and the time limit for annulment.

Process

1. Applicable rules and hierarchy

Satzung (BGB § 25)
↳ Verfahrensordnung / Strafordnung des Verbands
  ↳ Einzelne Disziplinarentscheidung

The disciplinary authority of the club/association does not follow directly from § 25 BGB, but from the articles of association in conjunction with membership (settled case law [unverifiziert]). Without a basis in the articles of association, no disciplinary sanction.

2. Formal legality

  • Jurisdiction: Did the body with jurisdiction under the articles of association decide (board, honorary council, sports court)?
  • Hearing of the member before the decision — an emanation of the general rule-of-law principle, applies by analogy in club law (BGH, settled case law [unverifiziert – prüfen]). 🔴 BLOCKER if absent.
  • Definiteness of the sanction provision in the articles of association (Art. 103 II GG by analogy in club disciplinary law [unverifiziert]).
  • Written form of the decision with reasons and notice of legal remedies (as a rule required by the articles of association).
  • Two-instance requirement for national associations before recourse to the arbitral tribunal (internal association appeal as a rule mandatory).

3. Substantive legality

  • Conformity with the statutory elements: subsumption under the provision of the articles of association.
  • Proportionality: suitability, necessity, appropriateness. Milder means (warning instead of expulsion)?
  • Judicial review of the content of the provision in the articles of association under §§ 138, 242 BGB (BGH on club disciplinary power: review only for gross inequity, but in the case of monopolistic federal associations, a stricter standard [unverifiziert]).
  • Interpretation in conformity with fundamental rights (third-party effect): Art. 12 GG (athlete's freedom of occupation), Art. 5 GG (freedom of expression), Art. 3 GG in conjunction with AGG, Art. 9 III GG for athlete coalitions vs. association monopoly.

4. Validity of Arbitration Clauses (Pechstein Line)

Athlete agreements with an arbitration clause in favor of CAS/DIS are generally valid (BGH, KZR 6/15 [unverifiziert]); in the case of a "structural imbalance," review of content:

  • Association has a monopoly position in the sport
  • Athlete must consent in order to participate in competitions
  • Selection of arbitrators / conduct of proceedings must preserve neutrality
  • ECtHR (Mutu and Pechstein/Switzerland [unverifiziert]): public hearing in disciplinary matters under Art. 6 ECHR

Consequence for the defense: the objection of invalidity of the arbitration clause opens the way to the state court.

5. Legal Remedies

Sanction First-instance legal remedy Deadline
Expulsion from a registered association (e.V.) Action for annulment before the Regional Court (§ 32 BGB / § 246 AktG by analogy) 1 month from receipt of [unverifiziert]
General meeting resolution (e.g., increase in dues) Action for annulment before the Regional Court 1 month by analogy to § 246 AktG
Association ban for professional athletes internal association appeal → DIS / CAS depending on the articles of association/rules; CAS: 21 days
Stadium ban Action for cessation/removal before the Local Court/Regional Court; §§ 858, 1004 BGB §§ 195, 199 BGB (3 years)
Arbitral award Application to set aside before the Higher Regional Court, §§ 1059, 1062 ZPO 3 months from service

6. Stadium Ban — Special Civil-Law Situation

Stadium bans are based on the domestic authority of the organizer (§§ 858, 903, 1004 BGB by analogy). BGH (judgment of 30.10.2009 – V ZR 253/08, BGHZ 183, 188 [unverifiziert – prüfen]): the exercise of domestic authority must not be arbitrary, an objective reason is required; the third-party effect of Art. 3 GG requires non-discriminatory application. BVerfG (order of 11.04.2018 – 1 BvR 3080/09 [unverifiziert – prüfen]) confirms indirect third-party effect. Nationwide stadium bans under DFB guidelines — review of content under §§ 305 et seq. BGB is possible if ticket T&Cs incorporate them.

7. Challenge Period and Legal Remedies

  • Expulsion from a registered association (e.V.): 1 month from receipt (by analogy to § 246 AktG; settled case law [unverifiziert]); according to some views, without undue delay within the meaning of § 121 BGB.
  • § 232 ZPO for the arbitration proceedings complaint / setting aside.
  • In the case of interim legal protection: §§ 935, 940 ZPO — urgently review before the season/competition decision.

Risks / Typical Mistakes

  • Hearing Omitted by the Association's/Association Body → sanction as a rule can be set aside; but: cure through hearing in appeal proceedings possible ([unverifiziert]).
  • 1-month period by analogy with § 246 AktG missed → cure of the sanction; consistent re-submission in the law firm.
  • Arbitration Clause Accepted Without Scrutiny → no Pechstein objection.
  • Proportionality Not Examined: exclusion as ultima ratio — warning / fine reasonable?
  • Stadium Ban Challenged with § 823 BGB instead of § 1004 BGB in conjunction with § 858 BGB → wrong legal basis.
  • Preliminary Legal Protection Forgotten before important competition → main proceedings too late.
  • Basis in Constitution not examined: disciplinary sanction without basis in constitution is void.
