Purpose
The skill reviews the traveler's rights in the event of defects after the start of the trip and quantifies them. It enforces the two obligations that most claims fail on — notification of defects and request for remedy — and clearly distinguishes between the statutory legal consequence (§ 651m BGB) and the table values used in practice, which have no binding effect whatsoever.
Inputs
- Tour operator, booking number, travel period, total travel price
- Description of services from the catalog, booking confirmation and pre-contractual information
- Description of defects per item with start, end and evidence (photos, witnesses, defect report)
- Time and form of the notification of defects, addressee (tour guide, emergency number, tour operator)
- Tour operator's response, remedy offered, substitute services
- Any termination with date and return travel costs
- Futile expenses and non-material impairment
- Contractually agreed end of travel (for the limitation period)
Sub-agent architecture
A researcher classifies the contract as a package travel contract, determines the tour operator and collects statutory provisions, CJEU and Federal Court of Justice case law as well as commentary passages. A drafter subsumes each defect item under § 651i (2) BGB, reviews notification and request for remedy, calculates the reduction in price on a daily basis and drafts the notification of defects and the claim letter. A reviewer checks the limitation period under § 651j BGB, the labeling of table values as mere guidance as well as every citation and marks unconfirmed items with [unverifiziert - prüfen].
Procedure
1. Package travel contract and opposing party (§ 651a BGB)
A package travel contract exists if the organiser procures for the traveler a combination of at least two different types of travel services for the purpose of the same trip (§ 651a (1), (2) BGB). The opposing party is the tour operator, not the service provider (hotel, airline) and not the travel agency that arranges it.
A distinction must be drawn from:
- linked travel arrangements (§ 651w BGB) — no travel contract law, only insolvency protection and information;
- mere brokering (§ 651v BGB) — liability only for the broker's own fault.
In-depth: /reise-fluggastrecht:reisevermittlung-informationspflichten.
2. Establish a travel defect (§ 651i BGB)
The tour operator owes the procurement of a defect-free package tour (§ 651i (1) BGB). A defect exists if the trip does not have the agreed quality or is not suitable for the contractually presupposed or the customary use (§ 651i (2) BGB).
The standard is the content of the contract: The catalog details, booking confirmation and the pre-contractual information pursuant to Section 250 of the Introductory Act to the German Civil Code (EGBGB) become part of the contract. Not every inconvenience is a defect — local customary conditions, general life risks and minor deviations are disregarded.
Section 651i(3) of the German Civil Code (BGB) sets out the traveller's rights exhaustively: remedy, self-remedy, assistance, reduction, termination, damages and reimbursement of futile expenses.
3. Duty to notify (Section 651o BGB)
The traveller must notify the tour operator of a defect without undue delay. If the traveller culpably fails to notify, he cannot, pursuant to Section 651o(2) BGB, claim a reduction and damages insofar as remedy would have been possible.
In practice: notification to the tour guide or to the contact point designated by the tour operator, not to hotel staff. Always follow up in writing or in text form and document receipt; the tour guide's defect report must be countersigned and a copy requested.
4. Remedy and self-remedy (Section 651k BGB)
The tour operator must provide a remedy (Section 651k(1) BGB); it may refuse the remedy if it is impossible or if, taking into account the extent of the defect and the value of the affected travel service, it causes disproportionate costs.
- Self-remedy (Section 651k(2) BGB): The traveller may remedy the defect himself and claim reimbursement of the necessary expenses if the tour operator has allowed a reasonable period to elapse. Setting a period is unnecessary if the remedy is refused or immediate remedy is required.
- Significant non-conformity (Section 651k(3) BGB): The tour operator must offer reasonable substitute services; if these are of lesser value, the reduction must be granted automatically.
- Duty of assistance (Section 651q BGB) in the event of difficulties encountered by the traveller.
5. Reduction (Section 651m BGB)
For the duration of the defect, the travel price is reduced by operation of law — a request for reduction is not required, but notification pursuant to Section 651o BGB is. The travel price must be reduced in the ratio in which the value of the defect-free trip would have stood to that of the defective trip; the reduction must, where applicable, be determined by estimation (Section 651m(1) sentences 2, 3 BGB). Any amount overpaid must be reimbursed (Section 651m(2) BGB).
The Frankfurt Table is not a statute. It is an orientation aid published in 1985 by the Regional Court of Frankfurt am Main without binding effect; it is neither a legal norm nor an administrative provision nor binding case law. It may be cited as a negotiation anchor and for plausibility purposes, but never as the legal basis for the reduction . The legal basis is solely Section 651m BGB; the decisive factor remains the assessment of the individual case.
Calculation method:
Tagesreisepreis = Gesamtreisepreis / Anzahl der Reisetage
Minderung je Tag = Tagesreisepreis × Quote der betroffenen Position
Minderungsbetrag = Summe über alle Positionen und Tage
Multiple defects are item by item assesses them; a mere addition of the percentages beyond 100% is excluded. The percentages must be substantiated, not copied from a table.
6. Termination (§ 651l BGB)
If the trip is significantly impairedby a defect, the traveler may terminate the contract — as a rule only after an appropriate remedy period has expired without success (§ 651l(1) BGB). Consequences: the organizer loses the claim to the travel price but may demand compensation for services rendered and still to be rendered insofar as these were of interest to the traveler (§ 651l(2) BGB). It must take the measures necessary to cancel the contract and repatriate the traveler (§ 651l(3) BGB); the organizer bears the additional costs of repatriation.
7. Damages and lost vacation enjoyment (§ 651n BGB)
- § 651n(1) BGB: damages in addition to the reduction, unless the defect is caused by the traveler, by a third party who was neither a service provider nor otherwise involved in the provision of the service, or by unavoidable extraordinary circumstances.
- § 651n(2) BGB — lost vacation enjoyment: If the trip is frustrated or significantly impaired, the traveler may also demand appropriate compensation in money for time off wasted to no purpose. The claim is non-material and requires a significant threshold; the assessment is based on the daily travel price and on the duration and intensity of the impairment. The basis in Union law is the recognition of non-material damage in travel law (ECJ, judgment of 12.03.2002 – Case C-168/00 "Leitner", NJW 2002, 1255 = EuZW 2002, 339, dejure.org; still decided under the Package Travel Directive 90/314/EEC).
- § 651n(3) BGB refers to international conventions for limitations of liability; § 651p BGB permits a contractual limitation to three times the travel price only for non-physical damage and only in the absence of intent and gross negligence.
Futile expenses (visas, vaccinations, equipment, booked excursions) must be itemized separately.
8. Limitation period (§ 651j BGB)
Claims of the traveler under § 651i(3) BGB become time-barred in two years from the day on which the trip was supposed to endunder the contract. The starting point is therefore the contractually agreed end of the trip — not the actual return, not knowledge and not the end of the year. Negotiations suspend the limitation period under § 203 BGB.
Deterministic calculation
The calculator in ../../../scripts/legal_calc/ performs only the arithmetic. The contractually agreed end of the trip, suspension through negotiations and assessment of the defect percentages remain legal inputs.

Risks / typical mistakes
- Notice of defects omitted or not provable. § 651o (2) BGB bars reduction and damages insofar as remedy would have been possible; notice to hotel staff is not sufficient.
- No deadline for remedy set. Self-remedy and termination generally presuppose the fruitless expiry of a reasonable period.
- Frankfurt Table cited as legal basis. It is a non-binding guidance aid; the legal basis is § 651m BGB.
- Reduction percentages added together. Items must be assessed individually; a total exceeding 100% is excluded.
- Wrong defendant. The defendant is the tour operator, not the hotel, not the airline, not the travel agency.
- Limitation period under § 651j BGB misjudged. The two-year period runs from the contractually agreed end of the trip, not from knowledge and not under the ultimo rule.
- Loss of vacation enjoyment claimed without meeting the materiality threshold. § 651n (2) BGB requires frustration or substantial impairment.
- Case number invented — verify every decision or mark it as
