Purpose
The skill reviews fine notices for administrative offences under the StVO/StVG, develops defence approaches (challenging the status of the driver, measurement errors, procedural errors, statute of limitations for prosecution, waiving of the driving ban) and drafts the objection grounds together with applications for evidence and access to the file. It clarifies the interface with traffic criminal law (Sections 142, 315c, 316 StGB) and the prohibition of double prosecution Section 21 OWiG.
Inputs
- Fine notice (time of offence, place of offence, accusation, BKatV annex position, fine, FAER points, if applicable driving ban)
- Measurement method / evidence (laser measuring device, PoliScan, ES 3.0, light barrier measurement, police observation)
- Previous course of proceedings (hearing form, witness questionnaire, date of service)
- Client's position (driver or owner liability; professional dependence on driving licence)
- Prior OWi entries (FAER extract)
Sub-agent architecture
Researcher provides StVO, BKatV, OWiG, OLG fine senate case law and BVerfG case law on standardized measurement methods as well as Burhoff and Krenberger/Krumm citations. Drafter drafts the objection grounds in judgment style with applications for evidence and access to the file. Reviewer checks the objection period Section 67 OWiG, the statute of limitations for prosecution Section 26 III StVG, the prohibition of double prosecution Section 21 OWiG.
Process
1. Formal review of the fine notice
Requirements Section 66 OWiG (mandatory information):
- Personal details of the person concerned
- Time and place of the offence (date, time, kilometre/address)
- Accusation with evidence (measuring device, calibration date, tolerance deduction)
- applicable provisions (StVO norm + BKatV annex position)
- Fine, ancillary consequences (driving ban Section 25 StVG)
- Instruction on objection and deadline
Defective notices may require further specification or — in the case of gross defects — be invalid (cf. Section 66 OWiG; OLG case law, [unverifiziert – prüfen]).
2. Objection period Section 67 OWiG
2 weeks from service of the fine notice (Section 67 (1) OWiG). The objection must be lodged in writing or on the record with the fine authority. Restitution to the previous state Section 52 OWiG in conjunction with Sections 44, 45 StPO.
3. Statute of limitations for prosecution Section 26 (3) StVG / Section 31 OWiG
- 3 months from the time of the offence until the issuance of the fine notice (Section 26 (3) StVG).
- After issuance of the notice: 6 months limitation period.
- Grounds for interruption Section 33 OWiG (in particular hearing of the person concerned, issuance of the notice) must be examined.
4. Standardized measurement methods
Recognized standardized measurement methods (e.g. ES 3.0, PoliScan Speed, ESO, Riegl FG21-P) enjoy evidentiary relief (BGH, order of 19.08.1993 – 4 StR 627/92, BGHSt 39, 291 [unverifiziert – prüfen]). Requirements:
- valid calibration (calibration certificate)
- Operation according to operating manual
- Tolerance deduction (as a rule 3 km/h up to 100 km/h, otherwise 3%; varies by device)
Inspection of raw measurement data and operating manual is defense standard — case law inconsistent: BVerfG, Order of 12 Nov 2020 – 2 BvR 1616/18 (right to be heard requires access to information not in the case file, [unverifiziert – Az. prüfen]); see also BVerfG 2 BvR 1167/20 [unverifiziert]. The OLG line is split (in particular OLG Bamberg/Karlsruhe more generous, OLG Düsseldorf more reserved).
5. Driving ban § 25 StVG
- Standard driving ban of 1 month for qualified violations (see Annex to BKatV).
- Refraining from the driving ban § 4(4) BKatV in cases of particular hardship (as a rule endangerment of professional existence) in exchange for an increased fine. Standard is strict: mere inconvenience is not sufficient (OLG Hamm, OLG Bamberg,
[unverifiziert – prüfen]). - 4-month commencement period § 25(2a) StVG (for first-time offenders: commencement within 4 months from finality can be chosen oneself).
6. Defense strategies
- Contesting the driver status (owner liability only for parking violations § 25a StVG; otherwise driver identification required).
- Measurement errors (setup location, missing calibration, deviating operating manual, reflections, front/rear measurement).
- Procedural errors (service, statute of limitations, double prosecution § 21 OWiG in parallel criminal proceedings).
- Refraining from the driving ban § 4 IV BKatV (professional hardship, medical necessity, etc.).
- Points and FAER: state the specific number of points only with reference to the applicable Annex to BKatV (check the current version).
7. Compelling the main hearing
After objection and scheduling of the main hearing (§ 71 OWiG), the affected person can submit further evidentiary motions. Waiver of appearance pursuant to § 73 II OWiG is possible. The appeal on points of law § 79 OWiG is only admissible to a limited extent (admissibility appeal § 80 OWiG).
8. Interface with criminal law
- Under §§ 142, 315c, 316 StGB the act is simultaneously a criminal offense. § 21 OWiG bars OWi prosecution if the same act is simultaneously a criminal offense and the criminal offense is prosecuted.
- With BAC above 1.1 ‰: absolute unfitness to drive, § 316 StGB (no more OWi proceedings).
- With BAC 0.5–1.1 ‰: § 24a StVG OWi (or § 316 StGB in case of relative unfitness to drive with signs of impairment).

Example (excerpt, judgment style)
III. Brief answer. The objection must be lodged within the period under § 67(1) OWiG. A reduction of the sanction should be pursued along two lines: first, inspection of the files concerning the raw measurement data and the operating manual of the laser measuring device used (BVerfG, order of 12.11.2020 – 2 BvR 1616/18
[unverifiziert – prüfen]), second, an application to refrain from imposing a driving ban under § 4(4) BKatV while setting out the threat to the client's professional existence.IV.4.d) Refraining under § 4(4) BKatV. The client, as a field sales representative, is strictly dependent on her driving licence; a one-month driving ban would with overwhelming probability lead to termination of the employment relationship. Under the OLG line of authority (OLG Hamm, order of 09.07.2019 – 4 RBs 211/19
[unverifiziert]) this is a case of hardship that supports refraining from the measure in exchange for an increased fine.
Risks / typical mistakes
- Objection period § 67 OWiG (2 weeks) missed — restoration to the previous position under § 52 OWiG possible only in narrow circumstances.
- Prosecution limitation period § 26(3) StVG not examined — a typical gap where fine offices are slow.
- Number of points or amount of the fine asserted without reference to the applicable annex to the BKatV — no indication of the version in force.
- Blanket refraining argument without specific presentation of the professional hardship.
- § 21 OWiG overlooked, where the same act is at the same time a criminal offence (in particular §§ 142, 315c, 316 StGB).
- Inspection of files not applied for — Raw measurement data and the operating manual are mandatory material for the defense.
- Owner liability Section 25a StVG confuse with driver liability (owner liability only for parking violations).
