About this skill

/energierecht:energieeffizienzpflicht

Purpose

The skill provides an overview of the energy efficiency obligations applicable to a company and assigns them to the correct addressee groups: energy management system (EnMS) or environmental management system (EMS) under § 8 EnEfG, energy audit under § 8 EDL-G, publication of material efficiency measures, interface GEG/CSRD. It prepares the evidence documentation vis-à-vis the BAFA.

Inputs

  • Company size (employees, revenue, balance sheet total – for SME classification under Recommendation 2003/361/EC)
  • Final energy consumption of the company (GWh/a, averaged over three years)
  • existing certifications (ISO 50001, EMAS, ISO 14001)
  • Group structure (affiliated companies for SME calculation)
  • previous energy audits (date, auditor, BAFA notification)
  • CSRD reporting obligation (yes / no / from which financial year)

Sub-agent architecture

Researcher provides §§ 8, 12 EnEfG, § 8 EDL-G, SME Recommendation 2003/361/EC, EU Energy Efficiency Directive (Directive (EU) 2023/1791), GEG interfaces as well as BAFA information sheets and CSRD/ESRS E1 references. Drafter creates an obligation matrix in authority/memo style with concrete to-dos and evidence annexes. Reviewer checks thresholds, deadlines and sanction risks under § 12 EnEfG / § 8 EDL-G.

Process

1. SME classification as a preliminary question

Standard: Commission Recommendation 2003/361/EC of 06.05.2003. SME = fewer than 250 employees and (revenue ≤ EUR 50 million or balance sheet total ≤ EUR 43 million), including affiliated and partner companies.

Non-SMEs are always subject to audit under § 8 EDL-G (every 4 years), regardless of their energy consumption.

2. Energy audit obligation under § 8 EDL-G

Element of the offence Content
Addressee Non-SME within the meaning of Recommendation 2003/361/EC
Obligation Energy audit under DIN EN 16247-1
Cycle every 4 years
Exemption If an EnMS under ISO 50001 or an EMS under EMAS is certified (§ 8(3) EDL-G)
Evidence Notification to BAFA via the online portal; retention of the audit documents
Sanction Fine of up to EUR 50,000 per infringement (§ 12 EDL-G) [unverifiziert – Höhe in aktueller Fassung prüfen]

3. EnMS-/EMS obligation under § 8 EnEfG

With the entry into force of the Energy Efficiency Act (EnEfG) on 18.11.2023, companies with an average annual final energy consumption > 7.5 GWh in the preceding three calendar years are obliged to establish an

  • energy management system according to DIN EN ISO 50001 or
  • environmental management system according to EMAS Regulation (Regulation (EC) 1221/2009).

Catalog of obligations (Section 8(3), (4) EnEfG):

  • Recording of energy flows
  • Identification of significant energy consumers
  • Assessment of economically reasonable measures for final energy savings
  • Publication of feasible measures and implementation plans

Deadline for establishment: generally 20 months from exceeding the threshold or entry into force [unverifiziert – Übergangsfristen in aktueller Fassung prüfen].

4. Obligation to implement significant measures

Section 9 EnEfG obliges registered companies significant energy efficiency measures to prepare, have confirmed by an independent auditor / an energy manager and publish. There is no immediate implementation obligation, but an obligation to justify non-implementation of economically reasonable measures.

5. Interface with GEG (building energy)

The Building Energy Act (GEG) regulates building efficiency for new construction and existing buildings:

  • Requirements for primary energy demand
  • Shares of renewable energies (Section 71 GEG – 65% requirement for new heating systems from 2024)
  • Energy certificate obligations (Sections 79 et seq. GEG)

The interface with the EnEfG/EDL-G is cumulative, not alternative: EnEfG/EDL-G covers total company consumption, GEG covers the building envelope and system technology.

6. Interface with CSRD / ESRS E1

Companies within the scope of the Corporate Sustainability Reporting Directive (CSRD, Directive (EU) 2022/2464) report according to the standard ESRS E1 (Climate Change). The ESRS E1 data points (energy consumption by source, energy intensity) overlap substantially with the data collected for an EnMS / energy audit. Recommendation: integrated data collection to avoid duplication of work – however, the mandatory obligations of the respective regimes remain independent.

7. Exemption and facilitation provisions

  • ISO 50001 / EMAS exempts from the audit obligation under Section 8 EDL-G (paragraph 3)
  • simplified audit procedures for companies below certain consumption thresholds (Section 8(4) EDL-G) [unverifiziert – aktuelle Fassung prüfen]
  • SMEs are not subject to audit, but may nevertheless be subject to other sector-specific obligations

8. Evidence to BAFA

  • Online portal of BAFA (Federal Office for Economic Affairs and Export Control)
  • Random checks
  • Retention of audit reports / EnMS certificates for at least 10 years
  • In case of violation: hearing, fine notice, complaint under OWiG provisions

Example (memo style, abridged)

Facts. Medium-sized industrial company, approx. 600 employees, approx. 9 GWh/a final energy consumption (3-year average), not part of a linked large enterprise.

SME status. With 600 employees, not an SME within the meaning of Recommendation 2003/361/EC (threshold: < 250 employees).

Energy audit § 8 EDL-G. Obligation every 4 years, as a non-SME. Exempt if ISO 50001 or EMAS are implemented (§ 8(3) EDL-G).

EnMS/EMS § 8 EnEfG. Obligation to establish an EnMS in accordance with ISO 50001 or an EMS in accordance with EMAS, as the final energy consumption of 9 GWh/a exceeds the threshold of 7.5 GWh/a. Deadline: generally 20 months from exceeding the threshold or entry into force of the EnEfG [unverifiziert – aktuelle Fassung prüfen].

Material measures § 9 EnEfG. Identification, assessment, publication; implementation obligation only to the extent economically reasonable.

GEG interface. To be reviewed separately (heating replacement, energy performance certificate).

CSRD interface. If the client falls within the scope, collect ESRS E1 data points in an integrated manner with the EnMS survey.

Recommendation. Step sequence: (1) implement ISO 50001 → satisfies both the EnEfG EnMS obligation and the EDL-G audit obligation; (2) display the audit report / certificate via the BAFA portal; (3) publish material measures; (4) data harmonization with CSRD reporting. Risk classification 🟡 due to deadline and sanction risk under § 12 EnEfG [unverifiziert – Höhe in aktueller Fassung prüfen].

Risks / typical errors

  • SME status calculated incorrectly – linked enterprises / partner enterprises not included, resulting in an erroneous assumption of SME status.
  • EnEfG threshold (7.5 GWh/a) confused with the EDL-G audit threshold – the EDL-G ties to non-SME status, not to energy consumption.
  • ISO 50001 / EMAS exemption overlooked – Duplicate effort.
  • CSRD data collected independently of the EnMS – Duplicate work, inconsistencies between the management report and the BAFA report.
  • EnEfG transition periods adopted uncritically – the applicability of the 20-month deadline must be marked in every application with [unverifiziert – aktuelle Fassung prüfen] be marked.
  • Sanction amounts taken from an older version – check § 12 EnEfG / § 12 EDL-G in the current official publication.
