About this skill

/dsa-dma:dsa-statement-of-reasons

Purpose

Art. 17 DSA requires that platforms provide a clear and specific reason for every moderation decision clearly and specifically. Blanket blocks ("violation of our terms and conditions") are insufficient. The reasons are published centrally in the DSA transparency database — deficiencies are publicly traceable.

Inputs

  • Type of restriction (removal, blocking, demonetization, reach limitation, account suspension)
  • Addressee (user / business user)
  • Occasion (own terms and conditions violation / illegal content under national law / trusted flagger report)
  • Automation (algorithmic / human)
  • Judicial or administrative order (Art. 9 DSA) underlying?

Process

1. Scope (Art. 17(1) DSA)

The obligation applies to restrictions with regard to:

a) visibility of specific content (removal, blocking, reduction of reach) b) monetization c) provision of the service (account suspension, termination) d) user account (temporary / permanent)

The addressee is the affected user, if known.

2. Mandatory contents (Art. 17(3) DSA)

Every statement of reasons must contain:

a) type of restriction and territorial scope b) facts and circumstances on which the decision is based (in particular whether the information originates from a notice under Art. 16 or from own detection) c) where applicable, use of automated means — also in the case of own detection d) in the case of illegal content: reference to the relevant legal basis e) in the case of a terms and conditions violation: reference to the relevant clause + reasoning f) information on possibilities for redress — internal complaint handling (Art. 20), out-of-court dispute settlement (Art. 21), court proceedings

3. Form

  • Clear and understandable (Art. 17(3))
  • In the language of the recipient — insofar as appropriate
  • Before or at the time of becoming effective of the measure

4. DSA transparency database (Art. 24(5) DSA)

Every statement of reasons is reported to the central DSA Transparency Database of the European Commission, with the following mandatory fields:

  • Identification code of the decision
  • Member State
  • Platform category
  • Restriction type
  • Reason
  • Use of automated means

5. Exceptions

  • Judicial/administrative orders (Art. 9 DSA) — special regime; the addressee of the order is primarily addressed (instead of the user).
  • Manifestly illegal content on the basis of a judicial order — no statement of reasons to the user is required if the order expressly prohibits it.

6. Legal remedy (Art. 20 DSA)

Platforms must offer an internal complaint management system :

  • at least 6 months after decision
  • free of charge
  • decided by non-exclusively automated means
  • Information about out-of-court dispute settlement (Art. 21)

Risks / typical errors

  • Blanket justification (“breach of our terms and conditions”) without a specific clause — infringes Art. 17(3)(e).
  • Automated means not disclosed — infringes Art. 17(3)(c).
  • Legal remedy notice missing or incomplete.
  • Forgot DSA Transparency Database report — Art. 24(5) is mandatory, not just the letter to the user.
  • Language choice unsuitable — statement of reasons in a language the user does not understand.
  • Statement given in response to court order although prohibited — can jeopardise the course of the investigation.
