Purpose
The appeal is the ordinary legal remedy against final judgments of first instance. It reviews the judgment for errors of law and for new facts or facts assessed incorrectly, but is subject to strict admissibility limits: grievance, time limit, grounds. The skill examines admissibility, calculates the time limits and structures the statement of grounds of appeal. A missed time limit or insufficient grounds leads to rejection of the appeal as inadmissible — without any examination of the merits.
Inputs
- First-instance judgment (court, date, operative part, grievance of the party)
- Amount of the grievance (value of the loss) or leave to appeal in the judgment
- Time of service of the complete judgment (for the time limits)
- Errors complained of: infringement of law and/or incorrect establishment of facts
- New means of challenge and defence (leave under § 531 ZPO?)
- Appeal request (extent of the challenge)
Sub-agent architecture
The skill works with three conceptual units. An admissibility unit examines whether the appeal is available under § 511 ZPO — grievance exceeding EUR 600 or express leave by the court of first instance. A time-limit unit calculates the one-month appeal period and the two-month grounds period, in each case from service of the complete judgment, and checks compliance with the mandatory time limits. A grounds unit assigns the complaints to the grounds of appeal under § 513 ZPO (infringement of law or facts to be taken as a basis under § 529 ZPO) and formulates the specific appeal requests and grounds required under § 520(3) ZPO. The units work in sequence.
Process
1. Admissibility and amount required for appeal (§ 511 ZPO)
- The appeal is admissible against the final judgments issued at first instance (§ 511(1) ZPO).
- Additionally required (§ 511(2) ZPO):
- Value of the subject matter of the complaint exceeding EUR 600 (§ 511(2) no. 1 ZPO), or
- leave to appeal by the court of first instance (§ 511(2) no. 2, (4) ZPO).
- Decisive is the grievance of the party, i.e. the value of the loss.
2. Grounds for appeal (§ 513 ZPO)
- The appeal can only be based on the fact that the decision is based on an infringement of law (§ 546 ZPO) or that the facts to be taken as a basis under § 529 ZPO justify a different decision (§ 513(1) ZPO).
- The local jurisdiction of the court of first instance cannot in principle be challenged (§ 513(2) ZPO).
3. Appeal period (§ 517 ZPO)
- The appeal period is one month; it is a mandatory time limit and begins with the service of the complete judgment, at the latest five months after pronouncement (§ 517 ZPO).
- Filing by notice of appeal with the court of appeal (§ 519 ZPO).
4. Grounds of appeal (§ 520 ZPO)
- The period for stating grounds is two months from service of the complete judgment (§ 520(2) ZPO), extendable.
- The grounds must contain (§ 520(3) ZPO): the specific appeal request, the designation of the circumstances from which the infringement of law arises, and the designation of concrete indications for doubts about the findings of fact.
Risks
- Appeal amount not reached — for a grievance up to EUR 600, the appeal is inadmissible without leave under § 511 ZPO.
- Appeal period missed — the one-month mandatory time limit (§ 517 ZPO) runs from service; after that the judgment becomes final.
- Grounds insufficient — if the specific appeal request or the concrete engagement with the judgment is missing (§ 520(3) ZPO), the appeal is rejected.
- New submissions precluded — new means of attack and defense may be admitted only under the narrow requirements of § 531 ZPO.
